    can anyone advise me please?

    I have written to HSBC requesting £2,206.17 (inc interest). I got a letter back saying they would look into it, so then sent the LBA. A few days ago I heard from them again appologising for the delay, saying they would respond by 3 April.

    I am concerned that by this time a decission will have been made by the OFT, so should I be patient and wait a few more weeks, or is now the time to start court proceedings through moneyclaim ?

    i have a court date of 31st march. Originally The Bank Of Scotland offered me 50% (£413.00) of my bank charges, without interest i said no. They then offered me full amount,(£829.00) without interest. i have said no. They then replied informing me that i had rejected amount and that they do not refund interest, is that true ? i then got a court date for end of february, but because there was a mistake (by courts) i was given another date for the end of this month. because the amount was over £750, i had to get sherrif officers to serve papers on bank. does anyone know of ANY claims going to court. not looking forward to that.

    I claimed and won against BOS (although i claimed in England) who paid interest as well the day before i could request judgement.. However, if you read through the main Reclaim your bank charges thread you may find the answer you seek. You cannot really claim interest until you have issued your claim. So, did they make the offer of the full amount before you issued the claim? I would also look at the 'Claiming in Scotland' thread as this does give you some very specific answers and most of the claims relate to Bank of Scotland claims. Good luck.

  • :mad: Hi, i recieved a letter 2 weeks ago from Colin Langdale refusing to refund my bank claim for £6600, so after being advised i sent another letter to the service quality team asking for my bank charges refund, additionally i stated that i would willing accept £5000. I have recieved a letter this morning confirming the orginal letters decision, stating that it is there final response, and if i want to take it further then i need to contact the financial ombudsman :mad: :mad:
    Any ideas what i do now ? Is that it for me, i wont be getting anything back ??
    i am so bleep bleep angry, HELP

    If that was your Letter Before Action you need to file a court claim.

    As it's over £5000, you should split the claim into different time periods (oldest first) to try and ensure it stays in the Small Claims track.
  • ok as i said in my earlier post i have now written twice to hsbc about my charges. the second letter gave them 14 days to respond so that was 2 weeks to day ago. (just a quicky should i give them 14 banking days ie mon /fri or is it 14 normal days? i am happy to wait til friday anyway as i did post them via royal snail so probably got them 2 days later!what do i do now? start legal action or send them one last letter saying i havent heard a thing from them?keen to keep on with it as suspect they are dragging it out til end of march?!
  • well i found another post saying that i should only claim interest if or when it goes to court. dont know if i should contact bank and ask if they will pay before goes to court, and just forget interest.
  • i too have been told to wait until april 3rd for response, i will not wait, i sent court threat letter on friday via recorded delivery,was recieved monday as i rang and checked it had been signed for,yet they said that the letter hadnt yet been scanned in, and i was told that all letters should be sent normal delivery as the building has 4 departments and normal post is sorted first :confused: not avin that tho as they will just deny they got the letter in the first place!
    their 7 days is up on friday if i go according to date on letter,but i will wait until monday and ring them first, il give them every opportunity to pay up, im claiming £2258 without int, its £2530 with int plus court fees on top of that so ive offered to accept £2100 if they pay up now,so i figure its a fair amount, its for 48 charges so they still got their money plus the int on my money from last few years.
    i was told over the phone that they are working on 8 week time scale from when they recieve the first letter, and at the moment most people are getting full response within 4-5 weeks, hence the first week of april as they scanned my first letter in on feb 27th. im waiting for this months bank charges of £100+ to drop onto door mat, they have been as helpful as ever, hubby lost his 2nd job so bit short at moment, yet bonus from main job due at end this month which they well know, yet no help just for couple wks, thanks for nothing hsbc :T
  • Okay, letter requesting statements has been sent today (not recorded, oops). New account opened ready and answers prepared for debt collection people when they come for my overdraft. Pretty sure my claim will be over £5000 so should get interesting. Fingers crossed all!
