    hannah - are you using the N1 form to submit your claim - I would recommend it as moneyclaim is way too limited on space.

    theres a great guide on the consumer action group site which shows you how to fill it in. I'll go find a link for you.

    I have gone through the whole process and got to the point where i finally took the bank to small claims court.

    A few days after my claim i recieved an offer, which i am going to turn down, from the bank (HSBC). I don't believe they made this offer because of court action as the date on the letter seems to be to early.

    My questions are -
    Do i need to notify MCOL that an offer has been made, if so how?

    Does this offer have any effect on my claim at all or should i just ignore it and wait for the bank to reply to my court action?

    The bank gave me no contact details except an address to write to, should i write to them turning down the offer or should i just wait the '7 days' the letter gives me to reply, in which case they will know that i have turned them down?

    I had a mastercard with hsbc which has now been closed, i didn't contact hsbc but called the financial ombudsman on 08450801800, they took a few details including the name of the Credit card company, my date of birth, name and address. HSBC sent me out an offer of 50% in less than 2 weeks, i didn't even contact them to let them know what amount it was for, hsbc worked it out for me!

    i'm not accepting the offer obviously but I would suggest people go through the ombudsman if poss, hsbc still haven't dealt with my other claim that i sent them directly, even though it was sent 2 weeks before!
  • Have put a claim in process with MCOL. I got a letter saying that HSBC had 28 days to respond etc Today is the last day and now i have got a letter from D&G Solicitors advising that in order for them to look into this matter they want me to provide a list of charges. Are they just trying to delay? Should i send it? Should i just wait for further response from the court?

    Please Help!

    PJH - 1. You only need to notify MCOL if you have accepted an offer and are not continuing with your claim.
    2 and 3. The offer has no effect on your online claim, in view of the fact that the letter may have crossed with your claim, they might well acknowledge and put in a defence as a matter of course. As regards declining their offer, if you want a quicker course of action, if you look back through this thread you will find a telephone number for the Quality Service Team - hold on - 0800 881155. I would ring and decline and mention that you've already issued a claim online. You could say that you would however be happy to accept £x and see what they say. Remember you want your court fee back! Good luck.

  • Well court forms are all filled in and I'm taking them down to the court tomorrow! Quite scared now!
    HSBC - £657 claimed

    1st letter sent: 14th feb
    Response: 28th feb - looking in to it
    2nd letter sent: 28th feb
    Response: none!
    Court Proceidings started: 20th March
    Claim served: 22nd March
    HSBC intend to defend: 22nd March
    Offer letter received: 28th March!

  • Ive looked thro a few pages and cant find an answer to mt question.

    I sent the letter requesting repayment on my bank charges, ive received the usual were looking into it response, but the time is up, so i want to send the letter threatening court action, but do i send it to my local branch or to Leeds?
