    I know this sounds a little stupid but i actually have about a year and i half of bank statements which i have kept (i knew they'll eventually come in handy) from say September 05 to Now. These statements are basically where all the charges occur. Therefore i don't have to send the first letter right? Also isn't it dangerous throwing away bank statments. No knowing who might get hold of em..... Anyway to the point do i still need to the 1st letter?

    Just had a phone call from a manager at HSBC sayiny they'll be doing my claim on Monday, so much for it being impossible to bumo it up the list. So a message for all you aspiring claimers, if they treat you like !!!!!! then turn on the water works and freak them out on the phone! It scares them into action, with any luck I'll be reporting a more favourable side of HSBC on MOnday, fingers crossed!!!:rolleyes:
    So far:-

    HSBC £2515 incl int claimes, settled on £1998:j

    Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

    Barclaycard - settled on charge difference:j

    MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

    HSBC Visa - no charges amazingly!!:rotfl:

    Household Bank Visa - settled on charge difference:T

    ACE catalogue - settled in full after 1 letter!!!:beer:

    my boyfriend is going through the process of recalining approx £600 from HSBC, they were quite slow but seemed ok up until recently. in mid feb he got the letter saying that they would credit his account with the money but since then he has had nothing, he has rang them many times but just been fobbed off; firstly they told him that they were experiencing a heavy back log and it would take time, then they told him to wait 5 days and see if it was credited, he has just rang them 5 days on and they wont tell him anything at all now, they have givrn him another number to ring but unsuprisingly no one will answer that one!!

    strangley he got a letter on monday which was the same as his last final one but offering him £20 less!!

    has anyone else had similar probs with HSBC? it is getting really frustrating now and i cant help but think they are delaying it until the new ruling comes in which means the charges paid could drop significantly, can they do that?

    if anyone has any advice i would be extreemly grateful as we were hoping this was going to be our holiday fund!! :(

  • I have a claim in with HSBC for £1641, today they offered £925 in settlement.

    the speel on the letter goes like this ' In circumstances where you would like us to make a payment from your account that would if met by us, lead your account going overdrawn or over an agreed overdraft limit, we have to consider whether to make this payment. A fee is payable for this service provided by the bank, details of which are clearly set out in our published price list. The circumstances in which the fee apply are clearly set out in Personal Banking terms and conditions which you have already been provided with. If your claim for a refund proceeded to court we therefore believe we would successfully resist any legal challenge in relation to these fees.

    is this just to scare me into accepting, the last paragraph got me thinking that i would lose in court!!

    what to do?

    There is a link to the costs of court and also a link regarding exemption for being on benefits in the Reclaim Help Thread, link in my signature. You need to file at your local court though rather than using MCOL.

    Standard letter from all of the banks, up to you now if you wish to accept or carry on for the rest.

    You need to send a letter before action giving them 7 days before you take it to court. The bank is only obliged to pay interest if it goes to court proceedings.

    Just count up your charges and send the claim letter to your local branch.

    You can add charges up until filing at court or MCOL.

    Yes just pick up the timetable and continue with deadlines as if there were no interval.
