    I was talking about the interest charged for going overdrawn due to spending not the interest you can claim as per Martin's article and yes I would advise as Martin does to add this interest to your first claim letter.

    Hi all, am at step 3 with my claim - had the letter back from HSBC sayingthey are "looking into the matters I have raised and will contact me with a full response as soon as (they) have completed (their) investigations". Obviously I am ignoring this and sticking to my timetable with my LBA to go off soon.

    My question is though, to what court should I refer on my letter? The small claims court?

    Is there any way the banks can make a note on future credit score files if you proceed with a reclaim? sooner or later banks are going to work out new tactics, what are the courts/judges making of all this re-claim culture. Are the views in the consumers or banks favour?

    Are they working on any new strategies, I'm nervous as I've only started my claim last week and feel the goal posts will be moved sooner or later.

    The name of your local court if you know it or just local county court.

  • all this waiting is doing my head in, and its only been just over a week! have sent letter with lists of charges asking for all of it back without interest (figured it might look bit better if i wasnt taking them for the lot) but my husband didnt realise i wanted it sent by recorded delivery so it was posted 1st class last thursday, we have rung them twice now and they keep saying that they are still opening letters from start of this week so may not have opened ours yet, so annoying, going to stick to my timescale whatever though, and send next letter next friday. i sent my last letter to my branch, do i do the same with the next one? plus, we are at the moment quickly tolling up yet more charges (moved house 2 months ago, still not 100% on money matters) can we get hold of them and say no to paying the charges in the first place? just an idea to avoid all this again. :o cant believe we let ourselves get here again :mad:

    I read your posting with interest, as I recently sent my letter requesting over £1000 charges to be refunded, however today I received a letter saying that they will look into my complaint and that it may take 4 weeks to respond??!!!

    I think in this case, I am going to reply with a copy of my original letter and let them know that I will proceed with court action if they have not responded to the original within the 14 day time limit. Will let you know how it goes!

    Spot on. YOU set the timescales for this, not the bank. Do give them sufficient time to reply to each letter you send though, 14 days is sufficient.

    From what i've heard, the judges are getting increasingly annoyed with the banks and some are now not even letting the banks enter a defence unless they can give a reason why they have settled every case so far. The banks are bordering on becoming vexatious litigants.

    As to credit files, very much doubt anything would be recorded, and if it were, highly likely to be challenged. You are making a complaint, they address that complaint. End of. - if every complaint was put on credit files they would be reams and reams of paper long!

    The banks have now started calling these charges service fee's instead, how they intend on convincing a judge that bouncing a cheque, sending you a letter saying its bounced, and then charging you £35 for the privilege is a service though is beyond me :p
  • I have finally sat down and gone through all my bank statements for the last 6 years and worked out that HSBC have been charging me a fortune between 2 current accounts. (in some cases upto £400 per month!).

    Has anyone had any problems with HSBC dragging their heels with paying out?
