I filled with MCOL and HSBC have put in a defence. I have completed and returned an allocation questionnaire 3 weeks ago, but have heard nothing from the courts. Is it usual to wait this long, also I have had nothing from HSBC..like another partial offer, what should I expect to happen next?

Hi, I too have filed an allocation questionnaire and not yet heard anything from the court although its only been a week for me so im not starting to worry too much yet. Good luck with your claim!

I sent my initial letter to HSBC with a list of charges on 30th Jan. I received a standard reply dated 6th February saying that they are looking into it. Since many people are saying HSBC have got bak to them within 8 weeks I have held off sending the second letter so far. Anyone think I should send the second letter now? Or hang on another 4 weeks?

    Many thanks

minifan, i'm in the same position. sent second letters (have 2 accounts with hsbc) on 20th feb, received what are essentially holding letters, on 26th feb saying they're investigating.

what's a reasonable amount of time to wait? i'm concerned as i heard something about a test case currently going through the courts on 17th april and therefore any new proceedings have being stayed pending its outcome. does anyone know if this is true?

  • Hello this is my 1st time here.
    Can anyone tell me
    - If i send the 1st letter requesting a fully comprehensive list of all past charges will they / can they close my account from this?
I know they have before but only when you ask for your money back, not at the begining stage.
All I want to know is how much cause if its the same as or more than my overdraft then i will try to claim, but if its not then i will leave it.
Sorry if this does not make sence :o

Right, thanks for the advice I am sending off my next letter today. I sent the letter listing the total charge I am reclaiming to my branch. I then got a standard acknowledgement letter back from the Service Quality Team in Leeds. Anyone know if I should send my next letter (the threatening with court one) to the Leeds address too???

    Many thanks in advance

    Hello!

I am still waiting for a reply from HSBC regarding charges to my bank account but received a letter from their credit card dept within a few days saying that they will not refund me the charges to my card. There were only £40 in charges so shall I just leave it? My other HSBC amount is over £800 so I'll keep pushing that one but should I continue the credit card one out of principal? Any advice would be greatly appreciated, thanks!

  • No response from HSBC so it's off to online court!

Does anybody know what i put for the defendent address? Would it be my HSBC account holding branch or the Service Quality office on the bottom of the letters?

    Thanks

    Advice please peeps!

Sent my first (14 day) letter inadvertently to Canada Square (statements address) and then sent my 7 day letter to the correct address in Leeds. I rang to check progress today and they said they hadn't had the first one but that a reply to my second letter (received yesterday) would be within me 'soon' with a follow-up later promising action in a few weeks or so.

If i stick to my timescales I should be going to MCOL tomorrow but I don't want to jeopardise the flow of proceedings later if I sent letter 1 to wrong address. But, does the fact that this was sent recorded delivery and received by HSBC in Canada Square still mean they were 'served' correctly?

    Thanks for your help. Lou.
