Well I now have all my statements and have gone through them and used the calculater to work out the total with interest (cheers for that feature folks). I have to admit it wasn't as much of a roadcrash as I expected, but I have had £1354 robbed off me over the years which amounts to £1546.67 with interest. I'd probably settle for the 85% hsbc seem to be offering, but the prospect of the merest chance of being able to send the bayliffs has me chuckling. Not HSBC, but HSBC***S.0

Just a simple question. I've trawled this thread and couldn't find an answer. Who should I address the second letter to, the one asking for charges back (on the envelope)? Should it be the manager or what? I gather that I can send this to my own branch so whats the answer. I'm probably being a bit thick here.
I also heard on the grapevine that the ombudsman is now looking into this charges thing so what is the update on that? I'm just worried that I may now have missed the boat!0 -

The letters are dated for the same day so someone made a boo-booNot your problem though and you are under no obligation to accept the lower amount.
Send another letter asap saying you accept their higher offer. If there is any quibble say you hadnt received the higher one at that point and have reconsidered your position in light of their error. They made the mistake not you. Nice to benefit from a bank screw up isnt it, congratulations0 -
There was something on the teletext yesterday about the Financial Ombudsman looking into banks who are closing accounts after customers have claimed unfair charges back. It said something along the lines of they were lokking into whether they were acting unfairly towards these customers can't remember now exactly but it may make the banks think twice about closing accounts.0

Send the 2nd letter back to the address on the reply you received to the 1st. <---- this bit is wrong so I am editing it right now to correct it. I misread your post I do apologise
Send the first letter asking for charges back to your local branch or hand it in and get a receipt. The letter they reply with will give you the address for your 3rd letter, details of which depend on its contents.
Dont worry about the OFT decision in april it wont affect the legality of charges banks made, just what the OFT consider reasonable. Unless the true cost of loss to the bank when you incur a charge is revealed then the premise of claims ongoing remain unchanged.

we got 2 seperate letters through from hsbc as well for the claim on my wifes account-do you think they may be slighlty busy and overworked :rolleyes:
they both landed on the doormat the same day, one for £1437 and one for £1497 which is juts over 90% of our claim-tough decision which one to accept obviously :rotfl:0 -
I'm claiming back approx £1300, I used the first template and they replied with "We're investigating, we'll get back to you shortly."
Nice to have a response, I thought. I was just getting ready to send the second letter after 2 weeks of giving them time to "investigate" when another letter arrived saying;
"Sorry it's taking so long, but we're investigating still and we will have a response for you by the 29th March".
Odd how the OFT decision is due around that time isn't it ? Do they think that I can't see they're putting me off until they get a more "official" or reasonable stance in their favour so they don't have to pay me back the full amount - Anyone else had responses like this ?0 -
Question:
Have just started proceedings through MCOL, which HSBC have acknowledged (05/03/07), to reclaim some £1800.00 plus court costs and interest.
Do the courts take into account the fact that HSBC are now charging me £75.00 per month (plus interest)just for having an overdraft facility - something that they began doing straight after recieving my first letter? Bearing in mind of course, that until this is settled one way or another i am incurring 'overdraft fees' as they put it, hence the total i claimed for is actually increasing since i filed the paperwork with the court.
Anyway, 26 days to go to see what the dirty gits are going to do. In the meantime im reducing my overdraft with them every possible way i can just in case they tell me to repay it immediately, as i have switched my salary to another bank.

Recieved acknowledgement this morning, and as predicted they are to defend the action i am instigating against them. Well, bring it on! Im holding out for every penny i have claimed.:beer:0 -
I finally have a result...........I arrived home last night to find a letter from the solicitors confirming that they would pay me the full amount. They originally offered me less than half, I turned this down and then they filed a defence and the solicitors wrote to me asking me to resend the list of charges and interest being claimed. I wrote back to them telling them that last time I looked I wasnt their secretary and didnt wish to do their admin for them as I had already sent this information to the bank manager on 2 occasions.....therefore if they wish to have this again they should contact him as I am not here to help them prepare their case and have already provided them with all the necessary information before lodging my case with the court.
I guess the letter worked as I am now sending back my acceptance today and will shortly receive the full amount requested - yipppppppeeee :beer:
I have been really scared that this might go to court but was always in this for the long haul and fully prepared to go the full course with this even though there was a small chance I could lose......it goes to show perseverence and a bit of stubborness pays off in the end.
To all you guys out there that are still going through the process. The only advice I can offer is hang in there.......the banks will pay in the end......they cant pay out to thousands/millions of others and not you, dont feel scared by the letters they send telling you that they feel sure they are going to win this case.....its rubbish, if they felt so sure they wouldnt need to use scare tactics and would just wait for their day in court, however they know this is rubbish which is why they choose to settle before this gets to court.....although its hard and although the prospect of actually going to court is a big worry its worth hanging in there! Thats just my advice though, obviously I am not a solicitor and can only go on my own past experience.

TOTALLY. hsbc didnt respond to my 7 day demand letter so i rang them yesterday to ask if they had any letters pending before i opened the court case with mcol - the girl said "well it says on my screen that you are due an offer in 2 weeks so if you just hold on..." yeah right! i filed with mcol anyway. same outcome either way so why not! plus i REALLY want to get the baliffs in..... :rotfl:0
