  • We submitted a court claim for £2,300 inclusive of interest and court fees. HSBC acknowledged and have 7 days left in which to submit a defence. However, we have today (7 March) received a letter from HSBC dated 14 February offering partial settlement of £1785 and giving us 10 working days in which to accept. There was no postmark on the envelope. They have said that if we don't reply within the 10 days, they will assume we have declined their offer. Obviously we had no chance to reply within 10 working days having received the letter 16 working days after they dated it. Do you think they deliberately backdated their letter? Should we respond using your 'I do not wish to accept the partial offer after submitting a claim' letter but insert that we received their letter dated 14 February on 7 March?

    We're not very familiar with computers and stumbled on doing a new thread by mistake. We are not sure how to view a reply on the website.

  • Hi - i have never used anything like this before but great website.
    I sent letters to HSBC in Canada Square for my charges back but no reply. So on the 26th Feb i started a claim on MCOL. The claim had started on the 28th Feb and today has been acknowledged and they will have 28 days to reply.

    I have just been reading some threads ans it states i should have sent the claim to Leeds.

    Im worried now can anyone help?

    If you get an offer or indeed the money into your account and you want to carry on you need to write back saying you will accept it in part payment and without prejudice but will be continuing to court for the rest.

    Any letter saying they will take 4/8 weeks is a standard letter and you need to carry on with your timetable and send the next letter or go to court.

    I would be very wary of accepting anything yet until I knew exactly what the conditions were. I'd give them a ring tomorrow and ask for a copy of their letter to be sent again before doing anything. I doubt you will lose the entire refund, many people have refused to settle and gone on to claim the full amount with success or at least a higher offer. Its up to you if you want to accept at this stage but I would clarify the conditions of acceptance first.

    Hello, i had the same thing with the Hailfax.We were on day 10 (or there about) from them acknowledgeing my claim, had a letter yesterday offering me half (£156) .This letter had no date and i was a bit annoyed that maybe they were up to some thing.
    So i phoned Halifax , spoke to a man and explained how this wasnt acceptable,while i was saying this we got cut off ! Well im not sure if he didnt it on purpose or not LOL !!! So i rang back ,i was put through to the same man,who said he would offer me £281 if i stopped court action.Which i have accepted.

    So i would say its worth maybe phoning and hopefully getting a bit more .I was offered £30 less than what i should have got but was just pleased for it to be over with.

  • HSBC are being slow sending out the offer letters but they are being very flexible on when you send them back. I don't think they are trying to do anything dodgy like backdating letters; you'll find they are so swamped with claims that they are just getting overwhelmed when replying.

    Hi,

    I have wrote a letter to HSBC about a month ago, just saying you owe me approx £100.00 - they wrote back saying you need to brake this down.

    So i did, and with interest they owe me £1250.00.

    I have wrote them a letter saying if they dont respond by tomorrow (09.03.07) I will be taking them to court.

    Can anybody confirm I am writing to the correct address (The Manager, Service Quality Team, HSBC Bank plc, Arlington Business Centre, Millshaw Park Lane, Leeds, LS11 0PP) - I have also sent all letters by e-mail to (servicequality@hsbc.com)

    Have I left it long enough to take it to court - It has been 1 month since the first letter went in.
