    So many informative posts , which is so helpful to many people .
    I now want to help so many people who are in a position that I was in 2-3 yrs ago , witht the advice that i have learnt over this period .

    Hi, wonder if someone could offer some advice. I have received Notice of Acknowledgement of Service saying HSBC are going to defent the claim, what happens now? Do I need to do anything? Thanks a lot x

    If they have filed an acknowledgment of service then they have 28 days from the original date the claim was deemed to have been served to file a defence. The court will tell you when this was but it is usually 2-3 working days after you issued the claim. If they don't file a defence within 28 days then you can apply for a judgement by default
  • How flamin' annoying are HSBC! :mad:

    My original letter was sent on Oct 9th, over 9 week ago and they are just dragging their feet. I sent a letter on Monday threatening to issue - should I just go ahead and do this?? I feel like their taking as long as possible so eventually they will find a get out clause and not pay me! Is anyone else having problems with HSBC? I'm claiming £868 without interest and could do with this before Xmas!!!

    Which letter? Your Data Protection Act request or Initial Approach for Repayment? Either way, you should follow this up immediately.

    If it was the DPA request, write to them and let them know the 40 days have passed and you will be informing the Information Commissioner and will also have the act enforced by the court in necessary.

    If it was the IAFR then you should have specified a timescale for their response. There's no need to wait for them to reply. Write your Letter before Action giving them 14 days and then if theyt still don't offer your money, start the court claim.
  • I received bank statements yesterday for my OH, dating back to February 2003. There was a period between May 2003 and May 2005 where he was charged for going over his agreed overdraft, total amount including interest charges listed is £477.03.

    I have highlighted these on the statements - it does not break down any of the charges, only lists as 'total charges £20.00' etc.

    What is the next step now - I am unsure of what to do regarding a spreadsheet.

  • The letter I initially sent on 9/10/06 requested all my statement, took them 35 days to send them. I replied straight away with details of the costs I want back and they're just ignoring me! I'll just issue! Thanks x

    Hi there, when I did mine I just did a list like this:

    Date Charge Applied Item Charge
    7/12/04 Total Charge 20.00
    7/12/04 Standing Order Recall 30.00

    and so on and that worked fine. On my statements some things were named i.e Re-call Standing Order but then a lot just said Total Charge.

    Hope this helps.

    Hubby is taking HSBC to court for £2969, he issued his claim on the 27th November, got a Notice of Issue this morning in the post saying that the court sent the claim to the defendant (HSBC) by first class post on the 29th and it will be deemed to be served on 01 December, the defendant has until the 15th december to reply.
    What i wanted to ask was, if we don't hear from them by the 15th December, does it mean we have won by default and can we then contact the court to order them to pay?
