    Do i have to wait for the 40 days to be up (it has now been 18 days since i received that letter) as they have in theory responded to my letter, or do i go ahead and send them the 'court action' threat letter?

    Sent my lba and a response was due back last week Tuesday, which I never rec'd. The total amount that I am claiming is approximately £4800 excluding interest. With interest it goes over the £5000 small claims amount. Is it still okay to go ahead and do the MCOL or should I reduce the amount?

    One other question, I called HSBC yesterday and was told that I should expect to receive a reply by mid next week and if I don't receive one that I should get back in touch with them. Should I wait until then or go ahead and file my MCOL?

  • You don't include the interest when looking at the £5,000 limit so your claim is okay being under £5,000. The decision is yours, if you are happy with negotiating an offer without the interest I would give them until next week, phone them if you don't here, before filing your claim.
  • I have an account with HSBC and I have been with finantial problems from allready some time to here, I know they have charged for cheque returns and direct debits recalls around £25 other times £30 or 3 times in same day £10 even £60 and all months at 27 of each month £125 of notified charges and a few £ of interest cause been breached the overdraft limit, what can I ask back all the charges or .....
    I really need some topic on this

  • Hi Fellow Claimants,
    After hearing Martin on Radio2 last week, i decided enough was enough. I'm self employed and have been for the past 15 years or so, unfortunately there are no guarantees as to when you get paid. I have an agreed overdraught of £500 and most of the time i use this facility. From time to time i go over, which HSBC call an unautorised overdraught and charge a fortune for. Unfortunatly i got laid off from work at xmas, which happens now and then. I called the bank and explained the situation and they said they would try to help. No such luck, a few days later i received a summary of charges, they charged me £150 for being over, returned D/Debits and charged £25 for that, over the past 3 months i have been charged, i guess around 7 hundred pounds in charges, so god only knows what they have charged over the past 6 years, i've written for details of all my charges.
    I have a credit card with the same bank and owe 1500 on it. will they make me pay this back when i win my fees back and they close my account?

  • Your credit card is a different agreement and should be okay. HSBC don't appear to be closing accounts and to be honest there is so much adverse publicity at the moment they would be foolish to start!

    Sent a letter to HSBC 7 days ago for £1200 worth of bank charges. I haven't heard anything no letter, no phone call, is this 'normal' just want to know should I ring them to see if anything is happen with it or just wait for the 14 days and then send a second letter? HEEEEEEEEEEEEEELP
  • You have given them 14 days to respond so you have to wait 14 days.

    Hi,
    I know its a bum clencher but you have to give them the full 14 days to respond. Its normal for them to string it out right to the last day in the hope you will have calmed down and lost your head of steam.
    You could prepare your next letter and have it ready to post if you want something to do, lol.

    Stick with it Hovis, i'm currently 9 days into my 28 on line claim period where Halifax have to defend themselves. I'm checking my bank balance every hour, hoping to see the £635 deposited, lol.
  • Thanks for the advice Smiler Argee it is a bit of a bum clencher as you hear all these success and you just hope your one of them. Also waiting for 9 months for combo after accident with a German lorry
