from HSBC's solicitors. It's not for the full amount, but near as damn it so I'm happy to accept it.

The account's closed so they're going to have to send me a cheque. Does anyone know how long it takes to receive the money?

By the way, that's the third win!!

I have had two claims now, the first took a nearly a week to go into my account from signing the acceptance letter, the second took about a week and a half and that was just last week. I think they are taking slightly longer now as there are more claims to deal with. :rotfl:
  • Hi all, thought I'd go through my statement (online) to see what charges I've incurred over the last 6 years.

Just curious, but does anyone know if "Total Charges" which I notice has been debited are the banks charges for me being overdrawn? It certainly looks like it.

    any help is appreciated. Thanks.
  • If they are, you can't claim normal interest charges for being overdrawn. If you don't know what the abbreviations stand for, please phone the bank and check. Post 4 in Reclaim Help Thread, link in my signature, lists what you can claim for.
  • Edinburgh lass I notice the interest charges are debited too, but under "interest" and debited on the same day as the "Total Charges".
  • Hi Everyone,

This is my first thread, on this GREAT site. I am hoping to get the maximum amount of money owed back to me through banks, loan companies and Credit card companies for ridiculous charges and penalities i have incurred over the last 6 years or more. But I couldnt find any thread that addressed what concerns I have...I really hope someone ANYONE can help.

My immediate concern may fall into the same bracket as those who wish to make a claim but feel they maybe unable to do so because of possible threats of banks closing accounts and in addition to which claiming back loan agreements that are also tied in with same banks you use on a day to day basis.

    I have watched the video from Martin and setting up the parachute account is a great idea. But I, like many others in the UK am in considerable debt, probably 30 to 40000 pounds in total. This would include credit cards and Loan agreements (student loans and bank loans). My questions, are as follows;

Q1) I operate a HSBC account and am now £150 overdrawn past my agreed overdraft limit of £1500. The bank have now reversed a standing order that would normally go out once a month because of insufficient funds and charged £25 for penalty charges. I wish to claim EVERYTHING all charges in the last 6 years. My problem is that HSBC also have arranged a £8000 loan with me. If I take this entire process of claiming bank ridiculous charges applied to me and threaten legal action, are they legally allowed to say...okay...we'll cough up what you have asked for...all penalty and late charges...we will now close your account...and we demand the £8000 back! Is this something that HSBC can do? If so, what timescale would they ask? also if not...why not?

Q2) I have one loan agreement with a subsidary of HSBC known previously as Household bank and now know as Beneficial Finance, of £3000. Over the last 6 years they have charged crazy amounts for late payments and £25 of transferring amounts to a current account. The type of loan i took out was a PLP (personal loan plus account), can I claim back late charges, administration fees and transfer fees of £25 in each case? Does it matter if its a subsidary of HSBC?

Q3) I also started paying student loans about 5 years back. Does the student loans company fall into the same bracket as claiming back administration fees? (same amounts of £15-25). Do they have a right to ask for the entire loan back in one go?

Q4) LAST QUESTION:) What is the worst case scenario for someone like me? Who is about to claim back possibly £1000s? What long term consequences will be held on my record? Will any of my actions in claiming back amounts have serious consequences in applying for a mortgage, or even taking out loans from other companies, credit cards etc?

Please advise me further, any help will be GREATLY apprectiated.

Thank you. (special thanks to Dean for bringing this article to my attention:)).

The first thing I would do If I were you is get the ball rolling by requesting DPA's from all of your accounts, loan agreements , credit cards , car finance companies and whoever else.
A bank was fined recently for closing someones account in spite.
Only £125.00 mind but they were fined all the same.
Anyway you need to send your DPA requests first so you can find out just how much you have paid in the last 6 years.
If you have had numerous regular charges you may find you are owed more than your actual loan amount that is outstanding.
As for harming your credit file by claiming back charges it doesn't affect you in any way.
I'm not too sure how they react to you if you have loans & overdrafts so won't advise you there.
I have just settled an account out of court with barclaycard.
    Here is the Lowdown:-

Originally I was owed £744.00 that they took in late payment fees and overlimit fees.
I sent them letter giving 14 days to refund my money.
    They paid me £372.00
This left them owing me £372.00
I spent a little on my card and then I refused to pay them anymore monies due to the fact they still owed me money.
    Then I filed my claim.
Since filing my claim they have accumulated £428.00 on my account.
They then passed this on to MERCERS debt collection agency who have pestered me for months and threatened me with bailiffs and such (which I laughed at).
They also applied a default notice and showed late payments on my credit file.

Last friday I negotiated with Barclays Solicitor that I would settle out of court.
    These were the terms:-
    1. They will pay mercers the £428.00 and get them off my back.
    2. That they remove the default notice and adverse credit history from my credit file.
    3. They pay me the difference they still owe me from my original claim.

I recieved confirmation this morning in writing that all my demands had been met and my cheque was in the post.

This brings the total of my re-claiming of charges to around £6,500 now.
And I haven't even started on my wifes claims yet.

I also settled against Direct Auto Finance this morning who also refunded charges and also agreed to remove charges added since my claim.
