Yes, you can continue.
All it means is they will take any amount awarded off of the debt you owe them and then any outstanding after, will be yours.

I recieved my first letter saying that they'll not refund my £260, so I replied that I'm not happy and would accept £200 if they settled early, I gave them 14 days or I'd take them to court, they replied a few days later saying they "carefully considered the circumstances" and are "unable to alter our original decision".
So should I still wait the 14 days before taking court proceedings or can I just do it now seeing as they have declined my offer?

I would wait the 14 days before filling in the court forms, you still need to show to the judge you have given them reasonable time to pay up. I'm guessing that as you've told them you're willing to settle for £200, they're assuming you're not that serious about the claim and so more likely to 'bottle it' when it comes to going all the way with your claim.
There is no need to negotiate with these people, the money is YOURS and if you stick to your guns you'll get the whole lot back. I'd urge anyone else not to make offers, this is a game of nerves but remember we hold all the aces!0 -

The only reason I offered a lower amount was because I do not want my account closed, though I know it doesn't guarantee it, I though it may help. Should I reply with another letter saying I am not happy with that decision and they have 8 days left to change their mind before I start court proceedings?

hi there, can any one tell me what happens if the bank cashes your cheque for the 10.00 fee, but u dont get your statements within the 40 days? they cashed my cheque 2 wks ago still no statements and only 12 days left before the 40 are up...:mad:

They cashed my cheque really fast too and I received my statements about a week before the 40 days were up. You cant complain until the 40 days are up but I would imagine you will get them shortly.0 -

Oh you are in the same position as me :T,
A&L have cashed my cheque on 19/03/07, they currently have 13 days left to reply,
I am tempted to ring them if i thought for one minute i wouldnt be stuck in a huge que for ages to then get a snotty person on the other end to tell me, "we are dealing with your request and you will receive your statements shortly".
I keep going home in my lunch break to check the post this week, costing me a fortune in petrol, I am about to pop home in a min, just thought i would check for updates on here.
Sorry I will answer your question now, if i dont get the information in the 40 days i am going to go to the Information Commissioner on the 40th day, once i have done another journey home to check the post, hope that helps,
