  • I received the standard reply saying they were not going to refund any charges so I posted Recorded Delivery the 2nd letter giving them another 14 days on 21st March. Royal Mail website still shows the letter as undelivered so I have phoned A and L and I was told they did receive it and a reply was sent to me on 24th March but they were unable to tell me what it said. I still havent received the reply and they are said that they are unable to do me another copy. Not sure why!

    So what do I do? Do I now just go to MCOL assuming its the normal second letter saying no or do I have to resend the second letter again due to the lack of proof I have?

    SUrely they should be able to provide proof of delivery - if they cant then it'd be exactly the same as one of us not being able to prove something we sent - we wouldnt have a leg to stand on and it'd be assumed that we never sent anything. So i'd assume theyhavent sent anything, but i'd ask for proof of delivery and demand they resend or tell them you'll assume there has not been a reply and proceed to MCOl.

    If I was you, I wouldnt beleive A&L, if you sent the letter on 21/03/07 they would of received it on 22/03 which then gave them 2 days to look at it and do you a letter, from what I have read on this thread A&L have been making us all wait up till very last minute, I would go to the information commissioner and explain that they "say" they have sent you a reply that you havent receievd it and they can not tell you what was in the letter, they would have a copy of this letter somewhere, hope this help's. Good luck, keep us posted, A&L have 9 days to get me my Statements, this really has been the longest 40 days ever.
    If any body has watched "40 Days and 40 Nights" i feel like the lad in that, about to explode, but for different reason's thankfully.

  • I have just received a call from A&L a Mr Raja from the Recoveries Dept!! Not sure why they are dealing with my account because its closed and I dont owe them any money. He said he understands I hadnt received a response but several have gone out and that they will resend the letters in next few days. I said its only the last one I havent had so I will wait and see now what I get.

    They do like to drag there feet dont they.
  • Thats something I suppose, atleast they are sending you a copy in the post. my account is closed as well so it is nice to see somebody else in the same situation and i can kinda know what to expect from them, difference is I owe them money which I am paying back monthly, basically they kept banging me with charges to the extent of £500 some mths so I closed my account being about £200 overdrawn, it was that or my OH wages get eaten away with charges each month, so once this is all sorted I will have wiped that debt off (cheeky t**ts, for every payment I make each month they add on 50% interest and refuse to stop this intill the account is up to date,) this is why i am claiming from them WITH INTEREST, I would be quite happy to go court over this, it has got to go in my favour that each mth since i closed my account i have been making regular payments to them as arranged with CAB, this has contributed to me being in debt, as big part of wages was taken straight out meaning we couldnt pay bills, bounced chqs, d.ds etc etc.

  • Go for it I dont blame you. I will be claiming with interest too as they registered a default against us even though I offered to pay it back in stages due to the amount of charges. The default is now settled but because of the state of our credit file because of A&L I am def gonna go with interest as our charges were from 2001-2003 so they will owe me loads lol. Hopefully!!

    They gave me my statements after around 30 days I thinks so hopefully yours will be there soon.

    We can take them on together. Just hope I get this letter they are talking about soon so I can start MCOL.
  • I hope you receive them soon aswell, c**p time for them to resend them being bank holiday, not alot you will be able to do now intill tues. Let me know what happens. We will take them on together, and win. . .

  • They will say that because it then gives them 28 days to come forwrad, but they won't because they don't want to expose their cost structires apparenytl :confused: so don't worry, if you don't hear after 28 days, go straight to the small claims court and ask for a win by default, I think it's called :o

    On a different note, what happens to the credit histories of people with Overdrafts (unauthorised) and is there a way to get the blemishes removed from an otherwise perfect record? :confused:

    Just received my A & L answer to the County Court Summons I issued against them. They've ticked the box saying they reject ALL of the claim. I don't mind seeing in the Court. Comet PLC did the same thing to me some years ago - attended the court to defend their 30 day policy for refunds or exchanges on faulty goods. Judge sent them away much out of pocket. He pointed out that Comet's "policies" had no basis in law.
  • Natwest have just annoyed me, just phoned up Barclays and requested a £30 charge be put back into my bank account "No problem Miss ????? I will do that straight away for you" phoned up Natwest and requested a £38 charge added onto my account today for a S/O which I had cancelled but went through and made me overdrawn "Sorry Miss ????? we can not do that" I said would you rather me close my account and get all unlawful bank charges back off you, "Yes you can do that, put it in writing to us but at this moment in time we are not giving you the £38 back" Stuck up C*W.
    I am not making a habit of going o/d, this is first time in ages, I cancelled a s/o with Natwest as soon as I know I wouldnt have enough funds in there, literally a few pound and Barclays was because my pay day is suppost to be every tues but my manager bring's me my cheque as of when is conveneint, it is really staring to annoy, but atleast Barclays are understanding and not charging. I'm going to give it abit longer with Natwest if they dont sort them selves out I will be claiming back from then, should only be about £200 from them though at max.

    Hi Becks - have you received your statement yet? A&L received my cheque on 27th Feb and came out of my account on 8th March. Finally received my statements on 3rd April and just gone through them now. I only joined A&L in 2005 and they have already racked up just over a 1000 in charges. They are so annoying - they refuse a direct debit because it will go over my overdraft and then charge me 34 pounds straight away which puts me over the overdraft anyway and then charge me another 25 pounds for going over my overdraft! Aaaargh. I never had a problem in Barclays (luckily i still have that account open so if A&L try and close the account i am ok, although i will complain about that).
