  • Ok, so I sent my 2nd letter to Alliance and Leicester last Tuesday. Total amount claimed was £227 + interest.

    I have had five credits to my account today, 4 x £25 and 1 x £34. I am presuming this is some of my charges being refunded?

    Has anyone else had a similar experience....and can I expect the remainder of the charges to be refunded soon in a similar manner?

    Yes this is one method of settling but without an offer letter and some form of acceptance to sign you are under no obligation to accept it and I wouldnt without checking exactly what the conditions of these payments are. There may well be a letter in the post on to you that you will receive soon. I would give them a call today if you dont receive anything in the post today and find out whats what. :)

    I have recently applied to the small claims court. The Alliance and Leicester have wrote back with this Acknowledgement of Service
    and i have noticed they have ticked the box 'intend to defend' now im getting a little scared. never been to court can anyone help

    Saying that they intend to defend can be used to delay the resolution of the claim and intimidate the claimant but not all banks go ahead and actually file a defence so try not to worry too much about this. If they do and you have questions just come back to the forum for help and advice.

    In the event that you do have to go to court this post explains a bit about what can happen in the courtroom for an undefended case. Please read it, it is very reassuring about the process

  • Hope you can help. Have you been successful in claiming back the monthly od fee of £25? This will make a great difference in the amount of my claim! Its £633 inc the fees but only just over £200 without the monthly fee. I have only been charged that fee when I have gone overdrawn.

    Saturday morning open a letter from courts to say defence has been acknowledged, next letter opened, a cheque from A+L for full amount + £200 odd interest so their payout almost double original claim.
    Why they did messed around I do not know it would have cost them a settlement of £400, and they would still have been in pocket, now they are almost £200 down.

    I havent been succesful but I am claiming it - it seems to me thats its just an unauthorised overdraft fee

    Thanks thats what I thought cos its only been charged when I have gone overdrawn. Fingers crossed eh!

    I'm still waiting for a response from my first letter - it took them 30 days to send me my statements.

    I am pursuing a claim for unfair charges with alliance and leicester. I was charged £34 three times on the same day for 3 dd's returned unpaid... then 2 x £ 25 for going into an unathorised overdraft and then another couple just for nthe laugh !!!! i then opened another account and changed all my finances over . This account still remains in an unathorised overdraft and they are asking me for the money . I of course dont want to put any in as the charges were unfair ... can i continue with my claim even though i technically owe them ?? I am worried if it gets to court they will say i owe them money!! .... can anyone help ???
