    hi all, I have submitted my claim against alliance and leicester having followed all the directions.The courts form states they have till the 20/3/07 to reply. I have heard nothing from them, are they supposed to write to me or money claim?
    I have tried to complete a default on line but it will not let me any ideas gang?

  • :j Having gone through the full process, up to using the moneyclaim website I have been refunded the £50 I was charged for going £3 over my overdraft limit in 2005. Interest, legal fees and a claim for postage and phone calls we also paid in full. They obviously do not want to go to court as the day before I sent the claim off I rang them and told them they has 12 hours to offer me all the money owed (after all the letters etc). A senior customer services officer rang back and offered me half the money - I told them politely where to stick it. They then said they would defend the case - THEY DIDN'T.

    On a related point surely something needs doing about the time it takes in this country to electronically transfer money - a bank holiday caused my transfer to take 6 days leading to the above problems as the computers don't work on weekends and holidays obviously.. In Sweden, I believe, it takes two hours.

    On a sour note they have now spat out their dummies and closed my account - don't care really as I have moved my business to another bank to get an introductory offer.

  • Hello to all the brave souls !

    In the process of taking the A&L to court for my partner (I shall be taking Lloyds to the same place in 3 days !).

    Sent my original request for refund in mid Feb which included all charges from Feb 01 to Feb 07. As my application to the Court was in March the Solicitor's letter from the bank says that i cannot request money over six years.

    As my original request for a refund was in Feb can I still ask that they refund these charges or do I reduce the amount entered via Moneyclaim ?

    The Solicitor at A&L is also asking for a breakdown of charges. Do I refer them to my previous letters or fax a new breakdown showing a reduced amount? Phew !


    Any light would guide my way nicely !

    In order for me to believe that you are not short changing me of a few hundred pound from my original claim, I would appreciate it if you could forward me a schedule of the charges you have refunded so far in the cheque I received on 01/03/2007, so I can compare it with the list of charges that I have raised against my account. If I am happy with this, I will inform the County Court that the case has been settled. However, if I believe there are still charges to be refunded, I will inform the County Court of a partial settlement and persue the remaining amount through the Court.

    Any news ? I have included any amount over the usual £5 monthly overdraft charges in my claim with the court. They are now asking for a breakdown which I will be glad to provide if I know I am right to include them ! HELP !!

    I have also put in a claim to get these charges back as I only had a monthly od fee the months I went overdrawn. The months I stayed within my limit I wasnt charged so surely we can claim them but any clarification would be great.

    i have seen that some of you have emailed a and l. what is the email address that you can contact them with as i have trawled the contact us on my online banking and cant find it anywhere.

    I have just checked and my letter with the cheque for 10 was recieved on the 14th. but they stuill havent dont the cheque so should i worry? what do you think? i want to get in contact with them to ask when they intend cashing the cheque and getting my statements to me.

    help muchly appreciated thanks ion advance.

    Statements arrived today... 29 days after i requested them.
    Apparently (my girlfriend has opened them but i havent seen them) it came with a little letter and in a big envelope, with 6 years of statements in (I am claiming from 2001)

    Jusxt though i'd let those of you know who are still waiting.

    Now i just need to add it all up and claim away.
    A&L - 1st letter requesting money sent 22/03
    - Standard Reply
    - 2nd letter requesting money sent
    02/04

    - Standard Reply
    - 23/04/07 MCOL claim started
    - 27/04/07 - Offer received & rejected
    - 28/04/07 - Letter fromA&L Solicitors stating intention to defend

    - Standard Reply

    - 2nd letter requesting money sent 21/03
    - 01/05 Received Offer for good amount
  • 29 days, that is good, is that with A&L, all the threads i have read, A&L have took ages to do anything, it took them 2 weeks just to cash my cheque, Good Luck

    Yesterday my wife received a letter from A&L Group Legal Services enclosing a copy of the Acknowldgement of Service that they had filed with the Northampton County Court. They think tha twill give them 28 days instead fo 14 to reply, I suppose, but unfortunately (oh dear, I forgot to tell them this) the copy they sent was in respect of someone completely different. I spoke to the Court helpline and they told me that no Acknowledgement of Service had been filed in my wife's case, so unless they get their fingers out they still only have the original 14 days before we ask for Judgment by default. Not my problem, though. These are supposed to be the legal experts; I'm just a layman.
    Has anyone actually succeeded with A&L, or do they just delay and delay hoping you will get fed up with the game?

    Well, what can I say.

    Sent all the letters and they refused point blank to give me anything.

    I served A&L with a County Court Claim on Monday 5th March 07 and I got back an acknowledgement of service saying they were intending on defending the full claim. Not going well at all!!!

    Got back from work today to find a nice fat cheque for the full amount of £1200 plus court costs.

    The system works, woohoo!! Thanks Martin.

    N.B. I did get a nice letter as well mind you stating that "It is clear that I do not accept the terms and conditions for the operation of my bank account and they will be contacting me shortly to discuss its future operation."

    Bye bye Alliance and Leicester bank account!!!

    Of course they don't dare defend the claim. None of the banks want a Court ruling for fear it may go against them. It's going to be much cheaper for them to pay up, grudgingly and often as a "Gesture of Good Will". One day they will get caught out and have to justify themselves in Court.
