  • happy to hear you are claiming with interest, keep us posted as to how it goes, i am really looking forward to getting my statement of bank charges from them and seeing just how much i can claim back off them, it really is like waiting for xmas day, i am such a big kid.

    I have gone through the process with Alliance and Lecester, done the statement letter, the 14 day letter and have now filed at court.
    A+L have sent a letter telling me they intend to defend as there answer is everyone else does it why not us?
    Have asked for a full list of how these charges have cost them, but no reply (strange) to that.
    They were supposed to file defence last Monday, but still have not heard from the court or the bank.
    How long does it normally take to hear?

    Give the court a call in the morning and ask if the bank have filed a defence. If not write to the bank and ask if they intend to file a defence. Then you can file for default judgement....but I would give the bank seven days to get their defence in.

    Did they acknolwedge your claim ?

    NO WORRIES NOW CHEQUES ARRIVED TODAY FOR FULL AMOUNT £655.25 Acknowledgement of Service from A & L on friday the 15th recieved cheque this morning 22.03.07 usual letter as i have read , "as its clear you do not accept terms etc shortly contacting you blah blah blah.... WHO CARES HE GOT HIS MONEY THAT WAS HIS (The court fee he owes me haha)

    Got the letter from A+L last Wednesday.
    phoned the court Thrusday for advice who said that no defence had been filed but they had till Monday to do so.
    Have heard nothing since from court or bank.
    as am writting this phoned the court who have said they have acknowledged it but now have to wait again till April to hear if they are going to defend it.
    Just a hint as well if on Working Tax Credits you can file a court case for free against the banks with proof of your WTC.

    So pleased - cheque received this morning from A & L for £981.76!!

    This is for the full amount - charges, interest and Money Claim Online fee. These were only for the year 2001 when we were going through a bad patch, and which made our situation worse!! Wish we could have claimed for more than 6 years, as the previous 3 years were also in the bad patch!!!!

    First letter sent with list of charges, on 16th February.
    They replied - all charges fair etc.....
    Second letter sent with intention to claim through court if no satisfactory reponse, on 27th February.
    They replied - all charges fair etc.....
    Claim issued with Money Claim Online, on 9th March.
    A & L filed an Acknowledgment of Service, of intention to defend all of the claim, on 14th March.
    Today - 24th March - they have not continued with their defence to court - cheque received!!!

    GREAT!!! SUCCESS FOR THE LITTLE PEOPLE TAKING ON THE BIG BOYS!!!!!!

    I hope this breakdown of my journey helps others. Do stick at it and don't be put off by the bank's letters, and taking your claim to court!!

    But I would not have done it without this site - I have spent ages reading the responses and the advice, help & encouragement from everyone who has posted, before I started my claim - so - THANK YOU - & - A BIG THANK YOU TO MARTIN - this site has helped us so much before, & now it has once again!!!!

    Learn from the mistakes of others - you won't live long enough to make them all yourself.

    I have recently applied to the small claims court. The Alliance and Leicester have wrote back with this Acknowledgement of Service
    and i have noticed they have ticked the box 'intend to defend' now im getting a little scared. never been to court can anyone help

    I have this afternoon been onto moneyclaim having filed against A&L on the 1/3/07. they say that no response has been recieved from A&L and that judgement in my favour has been submitted for finalisation which I believe means I have won??
    However the jumping for joy has not began as it seems A&L aknowledge most of you guys with a defence then settle a short while later. the thoughts why not I jump to mind Am I worrying unnecessarilly? anyone else been in this spot latley?

    Hi Herbie,

    Same happened to me. They said they would be defending - but didn't. I received a cheque about 5 days after that (full amount, and interest and MCOL charge) the cheque cashed last monday, so hang on in there!

    I had exactly the same reply from nationwide it did make me panic as well i have never even thought of doing anything like this before but most banks will reply with 'intend to defend' to try and make people give up but dont its just a scare tacktick that they use. so dont worry x
