    URGENT INFO. FOR ALL THOSE ABOUT TO START CLAIMS (FROM CAG SITE) :-

    Do NOT go through MCOL as all claims are being "Stayed" through this route. If you go through your local court, you have a better chance, though nothing is guaranteed. Each court is treating bank charges cases differently :-

    Please help, My court day was the 6th of November 2007, I have received a letter this morning from the court saying that it's not going to happen until the results of the test date, i.e it has been stayed. I want to know whether there are any letter templates that can help me appeal against the stay. Many thanks.

    Yes there is an appeal application against a Stay on the CAG site. It's probably quite doubtful you'll be successful in all honesty ... I've only heard of a handful of people due in court in Hull having had success, although it is up the individual courts and it's also early days yet, so it may well be some people are going to be successful over the coming months.

    Do MCOL have the right to stay claims without it being transferred to your local court?
  • Hello all,

    Alliance & Leicester have charged us 2 x £25 for our joint account going overdrawn. The reason the account went overdrawn is an error on their part, but because of the court case they will not refund!!

    Back in January my wife and I got our first mortgage with Alliance & Leicester, this spans over 40 years. The way we pay our mortgage is out of our new joint account with Alliance & Leicester, we both pay from our personnel accounts into our joint account the money for the mortgage and all our bills. We are both payed on the last day of the month, we initially set up a transfer to go to our joint account on the last day of the month. We ran into problems when for instance a bank holiday weekend where the money would not get to the joint account until the 4th or the 5th of the month, this made our joint account overdrawn, and we were charged. I phoned A & L and explained the situation and thankfully they refuned the charges and advised we would need to change all our direct debits to go out on the 5th of every month so it would not happen again. My wife an I contacted all the companies who we have direct debits with and asked to change the day these we're payed, this was fine except for two companies which was TV licence and the Water board, they could not change the day. So we then decided to pay these two companies from my wife's personnel account, so we phoned A & L in March and advised them this is what we wanted to do, they said we would need to phone TV licence and Water board and get them to change which account they took the money from, which we did. When it came to these two companies trying to take the money from my wife's account A & L refused, so the 2 companies took the money from our joint account, on this occasion luckily we had enough money in the joint account. this went on for a few months unoticed because we had enough money in our joint account, then at the beginning of July my wife noticed that A&L had refused these direct debits, initially my wife thought she was in arrears with the water board, so my wife phoned A&L and expressed her announance that they had refused the direct debits and she was now in debt. At this time A & L were not even able to tell that in fact the money had still been coming out of our joint account...imcompetence! Anyway at the end of June our joint account went overdrawn because of the A & L not doing as we instructed. These charges came onto our joint account shorlty after July 27th. I have phoned A&L and explained that in fact the reason the account went overdrawn was their fault and not ours. But because of the court case they they will not refund. :mad: I cannot beleive that when we have got a 40 year mortgage with these people and the reason the account wen't overdrawn was their fault they refuse to refund. On top of that with interest rates on the rise and us being first time buyers, you do really begin to understand that A&L would be quite happy for us to go under and lose our house. I am completley disgusted!

    I am sorry to hear of your predicament and hope someone will help you.
    You just confirmed to me how awful their customer service is.
    My problem is nothing compared to yours.
    It is 3 months since I made an error with a payment and they still dig their heels in and keep sending me back to the other bank(nationwide) who has done all the work.I shall jump ship next year and I will never ever use alliance-leicester ever again.

I called the courts the other day and was told that if you have a court date the case will go ahead although I am not holding my breath.

I called the courts the other day and was told that if you have a court date the case will go ahead although I am not holding my breath.

    I got judgment by default (eventuallyrolleyes.gif). The cheque arrived on the morning of the hearing BY COURIER! They had to get the money to me before the court hearing. When I rang them a couple of days before court after they'd emailed me a letter offering settlement in full, they seemed "unaware" that the court date was imminent (even though they'd been told time and time again). There was a postal strike on, so they had to pull all the stops out.

    I was not informed by the court that judgment had been awarded until a week AFTER the cheque had arrived, though I presumed this was the case!

    I doubt very much you'll have to go to court but, if you do, it should just be a case of turning up for a couple of minutes to hear the judge confirm you've been awarded judgment.
