There's a note on the HSBC site that they're doing this too. I think some have been allowed to do it.

Well got a phone call from solicitors today, they are taking me a little more serious now and sounds like they are going to get something sorted, gave them until Monday afternoon, and insisted on another update phone call, at least they are making plenty of money from A & L, as I used to do Solicitors bills and they can charge up to £5 for each phone call or letter made/received
Got the money today, and I had just sent the letter to high court Bailiffs, luckily they only opened it this morning, so didn't incur extra charges.....:j:TReclaimed thanks to this site: £2596.71

I have just been served with a default notice from alliance and leicester for just over a grand which is all bank charges !!!!!!!
I am in the process of claiming it back but they have put all claims on hold until after this test case which is happening sometime in the next year....:mad: :mad: :mad: :mad: :mad: :mad: :mad:

I am in precisely the same situation - Alliance and Leicester seem to be getting very ugly. They are saying that I have to pay the outstanding amount, even though the vast majority of the amount is bank charges. Surely they can't take me to court for an amount that is in dispute and has been frozen. This is entirely unfair as I can't go to court to prove my case, however they can take me to court for the debt, no matter how it was accrued.
I would really like to know where I stand.0 -

A few months ago, I accidentally used bank funding on Paypal instead of my debit card (another account). This meant Paypal tried to debit my Alliance and Leicester account. This was a new account with nothing in it, so Alliance & Leicester denied 2 of the direct debits, and paid one. They didn't charge me for the ones they rejected (it's a Premier 21 account).
This meant I was unauthorised overdrawn for £11. I didn't realise for a few weeks, but I knew there was money going into the account at the end of the month anyway. The money was paid in, and brought my account back in order. They also charged me about £5, which I thought was fair.
I continued using my account, keeping a positive balance. I then went on holiday, and returned to letters from the bank informing me I'd been charged £99.20.
I have 3 questions...
1) How on earth can they justify charging just about £100 for being £111 overdrawn for a few weeks
2) Why was this charge not applied for a month after?
3) Can I claim it back from them?

Today I received my statement from Alliance & Leicester. I only use this account to keep up my regular saver account which is ending this November.
There is a section at the bottom of the letter detailing charges that will be taken out of my account on 27th September detailed as follows.
Unauthorised Overdraft Charge
Day 1 £25.00
Day 5 £25.00
The dates that I was overdrawn on were 10th August. I actually noticed when logging on to check my account around the 15th and at once credited it with the appropiate amount (and then some more too)
Obviously this charge is a disgrace and I don't want to pay it. The transaction that took it over the limit was to their linked savings account.
So what should I do now?
I've seen template letters about reclaiming charges that have already been paid but what about stopping them applying them in the first place.
Should I call/email/write to them. What should I say. Quote sections of law or just ask them to see a commonsense approach?Wycombe Till I Die0
