    Just before the announcement regarding test case we were in process of putting together our claim for bank charges to Alliance & Leicester.

    We are becomming incredibly irritated by A&L with the amount of charges they are putting against our accounts on an ongoing basis.

    For example, I have just received 3 charges of £34 (totalling £102) due to unpaid direct debits (I was £2 short to cover the DD's!!!!) - all of charges taken STRAIGHTAWAY, so I am now £102 overdrawn, which will then incur overdraft charges for £25 at the end of the month! I find this totally infuriating and unfair! :mad:.

    My partner has been charged for 1 month's overdraft FIVE TIMES @ £25 (totalling £125) due to the number of days he was overdrawn (which again was caused by them taking their charges!!)

    How can they get away with refusing to pay a Direct debit due to "insufficient funds", yet continue to take the charges??

    Is there ANYTHING we can do to prevent further charges being taken during the test case period? I read a post that Barclays had stopped charges being made to a customer - can we appeal for similar?

    We will still be submitting our claims over the next month.

    Any advice would be helpful.

    After you issue your claim and assuming that a stay is applied for by the bank you should ask that if a stay is put in place then that the bank be barred from applying any further charges until further order. There is a technical reason for using that wording and hopefully no one will notice.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Yep, think you're right ... all the bank charges forums seem quieter at the moment.rolleyes.gif

    I think there's little many can do at the moment, apart from appeal against Stays.

  • about 8 weeks ago i handed in my aq to my local court but since then i have not heard a thing. can any1 tell me how long before i get a court date if there is to be 1 being that i have seen on here many people being notified of stays:confused::confused:

    Has anyone out there managed to reclaim bank charges from Alliance & Leicester? I am considering taking my claim to the courts in Scotland - any advice?
  • I'm after a bit of advice about A&L too. I'm new to all this bank chanrges thing as until July I'd not been charged anything by anyone. Anyway the (not very) short story is...

    I had two regular payments set up from my A&L premier account to my A&L savings accounts. I was closing the current account as I'm so fed up with the crap functionality of the service. I thought I'd cancelled all standing orders, direct debits etc. None were showing on the lists but as per the crap functionality, there were two regular payments due than don't show. :(

    They took the payments from the account with no money in it. Charged me £25 for each transfer due to insufficient funds, then £25 for being overdrawn. So I'm £75 down due to two payments I thought I'd cancelled and couldn't see were going to happen - grrrr!

    I've complained, been told to go away, complained again and now have a letter saying due to the OFT thing all claims are on hold for a year.

    Do I have to wait now or is there anything else I should be doing in the meantime? and can I close my account? it's supposed to have £500 added per month and there's no way I'm giving them any more money!

    well i have been claiming charges from A & L for my mum, we filed for Judgement by default, as they had not filed papers in response to ours in the allocated time.....then the OFT made there announcement...

    The following Tuesday 31st July the judge awarded us Judgement, meaning A & L, had to pay up the full amount..........so far no money...so I sent their Solicitors Wraggle & cothis letter....


    [FONT=&quot]I am writing to request that your client repays the monies owed to me, in accordance with the Judgment Order dated 31<sup>st</sup> July 2007, It has now been 26 days since this Order was made and despite numerous phone calls I have yet to see any money.<o>></o>>[/FONT]

    [FONT=&quot]I feel I must therefore instruct High Court Bailiffs; Elliott Davies, to recover this money on my behalf, at addition cost to your client.<o>></o>[/FONT]

    So far no money or phone call......but i will send in high Court Bailiffs as they have more power to get the money...I hate being ignored.....and they can take anyone's money the same day...but takes them weeks to give back......

  • Short version - went £2 overdrawn, and bank charged me £50! Phoned up and said about it, and they are point blank refusing to deal with any enquiries regarding charges since the financial ombudsmen did the whole bank charges thingy.....even though this was not a claim, just be phoning to point out that charging me £50 for going £2 overdrawn was unreasonable....

    I said that I could not pay the £50, and they said it would be logged. I also asked them to assure me that no further charges would be applied, and they just re-did their bank charges spiel.

    Thought that was the end of it - but have now been sent a letter demanding £89.51 - stating that if I don't pay it further charges will be applied.
    I don't know what to do - do I fight it and hope I don't ecru any more charges, or pay it and try and claim it back later?

    This is in addition to the trying to reclaim charges already from them - which was halted right in the middle due to the 'stop press'.....
    Is it payday yet?:rolleyes:
