hi all the court is Brighton , i have recieved a letter from them to stating
" the court is aware that a test case has been issued to be heard in the commercial court between 14.01.08 and 28.02.08, to determine the issues of legal principle to recovery of charges debited to bank currant accounts
Upon it appearing to the court that the issues raised in the test case will affect this claim
It is Ordered that :
1. The claim be stayed until further order.
2. There be permission for either party to apply to lift the stay specifying why the claim should not await the test case decision
3. The parties are to notify the court no later than 7th March 2008 in writing whether the claim has been settled or withdrawn or whether a hearing is required for directions for trial,
4. The file will be reviewed by a District Judge on the 7th March 2008 "
i am a little bemused by this and am at a lose as to what i should be doing now ? any help ??

Sorry if this has already been answered.....I finaly recieved an offer from a&l for the full amount after going through MCOL. I signed this paper and sent it back 2 weeks ago...then this week recieved a letter saying they wont pay it as its all being investigated about whether the charges are unfair? Has anyone else recieved this letter? made me so mad, thought i was finaly going to get some money! thanks

i had a judgement by default against the a&l on the 24 july 2007.They promised to pay me within 5 days(sent by email and saved by myself as proof)...as you can imagine they are messing me about.So after reading peoples verdicts on this site and the CAG site i have been in touch with this company

Hi,
I was looking at my statements from my A&L account (I'm using the MSE recommended one), and in the last couple of months I have been charged over £200, for what appears to be a mistake. It started with a single valid £34 charge for a DD that failed for want of 20p (bigger than normal phone bill, which i never got because they messed up my address, and I was then also charged for the failure by the phone company, nice), which took me over drawn, so it immediately added an unauthorised overdraft charge for the same thing. This was paid off, and they then added two more delayed charges for being overdrawn, and another charge for going overdrawn to pay those charges. I've looked at the paperwork, and all these charges are listed unfortunately - it just seems to be unfortunate timing, but they really have charged me over £200 for being overdrawn by 20p!
I phoned to complain about this, and the lady on the phone agreed that the complaint was reasonable, the charges were crazy, and they would normally not charge £200 for being 20p overdrawn BUT told me they will not do anything about any charges because of the OFT test case, and they can't even discuss it. I was very nice and polite too, in the hope they would just be nice about - I've not had the account long. I don't really think the case applies to this complaint either - I'm not debating the scale of the charges, but whether they should ever have been applied.
Is there nothing I can do for the next year or so? £200 is a lot of money to lose, especially for something so silly!

So I haven't got round to claiming my charges yet (too lazy) but A&L have an noyed me. I received 2 x £25 charges on 4th August for being overdrawn 19th June - 19th July. I had already been charged £50 in July for being overdrawn 19th May - 19th June. I had gone over my overdraft on 9th June and then my wages went in on 25th June. By my reckoning this warrants the charge for day 1 and the charge for day 5.
I spoke to A&L on 5th August and asked why I have been charged again for being overdrawn. They said that as my account runs until the 19th of the month that the charges were applied again but she said as they are 'knock on' charges she would get them refunded.
I called again today and have now been told that this refund is on hold pending the test case. I have also received notification that due to these charges making me over my limit that charges will be applied in September then again in October as we are past the 19th.
I asked if I could speak to a team leader and she said no not regarding these charges. I have put my complaint in writting.
Has any one else had these 'knock on' charges applied and can tell me the rules regarding these. technically that is £100 charges for being overdrawn for 11 days.

I agree, your charge seems ridiculous
There's nothing to stop you starting the claim process by sending the first letter off. If eventually there is a Stay, this is up to your local court, not A&L. Each individual court is treating it differently and may or may not apply a "Stay". You never know, as it's a relatively small amount, they may even pay up after a letter.

I have only just registered tonight but after reading the various forums for weeks and weeks, i am still confused about the whole A&L Bank claim especially after the test case announcements etc. I am owed almost £2000 by A&L.
I have been offered a few various amounts through Wragge & Co which i have not accepted and i am now due in court at the beginning of Sept. Are there any templates that people have used to present their case and do you have to give reasons to the judge why you are claiming etc. I am really sorry if these are stupid questions but as the time to appear gets closer, i am getting more nervous and starting to wish that i had accepted the pittance that they offered. Any suggestions will be very gratefully received. Good luck to everyone in the same boat0 -

The best advice I can give you is join up on the CAG site (Consumer Action Group). I'm presuming you haven't already?
