Had result today!
I Followed all guidelines for return of £317, have been ignored by A+L every step of way. Commenced MCOL proceedings defended by Wragge & Co, court date set for September 5th, understandably nervous but prepared to appear.
Wragge & co. offer of full settlement of £315 + £50 court fee last week, accepted as only £2 shy of what we were after!
Today received cheque for £405!:rotfl:
THANKS MARTIN AND ALL PEOPLE FROM THIS THREAD!!!

well i have been claiming charges from A & L for my mum, we filed for Judgement by default, as they had not filed papers in response to ours in the allocated time.....then the OFT made there announcement...
The following Tuesday 31st July the judge awarded us Judgement, meaning A & L, had to pay up the full amount..........so far no money...so I sent their Solicitors Wraggle & cothis letter....
I am writing to request that your client repays the monies owed to me, in accordance with the Judgment Order dated 31st July 2007, It has now been 26 days since this Order was made and despite numerous phone calls I have yet to see any money.<o>></o>>
<o>> </o>>
I feel I must therefore instruct High Court Bailiffs; Elliott Davies, to recover this money on my behalf, at addition cost to your client.<o>></o>>
<o>> </o>>
In order to avoid this you must immediately transfer this money by close of business Thursday 30th August 2007, if for any reason this is not possible I would insist that a member of staff, inform me of a valid reason by phone on 01663-7******.<o>></o>>
<o>> </o>>
I have also sent a copy directly to Alliance and Leicester.
So far no money or phone call......but i will send in high Court Bailiffs as they have more power to get the money...I hate being ignored.....and they can take anyone's money the same day...but takes them weeks to give back......

Well got a phone call from solicitors today, they are taking me a little more serious now and sounds like they are going to get something sorted, gave them until Monday afternoon, and insisted on another update phone call, at least they are making plenty of money from A & L, as I used to do Solicitors bills and they can charge up to £5 for each phone call or letter made/receivedReclaimed thanks to this site: £2596.71

Received letter from Kingston County Court today, stating that the defence stands struck out and Alliance and Leicester must pay in full plus court fees by the 6th September, does anyone know if they will pay or what they will do next?0

I Have Now Recieved My Letter From Alliance And Leicester Telling Me They Are Really Really Sorry But They Sent Out Their Letter By Mistake And That No Offer Was Ever Made To Me ?0
-
hi
i would think that if they had put a figure in the letter then they would have to honour it! if they havent though, the offer can not be verified..they could say it was just £1!!!0 -
Grrrrrrrrrr.
I sent off my early judgement for a case that was due in court on the 9th but got a letter that a hearing had been made early and that the stay had been applied.
Now get a letter today about my early judgement saying that because of the stay it's basically being ignored!
I handed in my judgement form about 3 days before the stay was sorted out!0 -
Sorry if this has already been answered.....I finaly recieved an offer from a&l for the full amount after going through MCOL. I signed this paper and sent it back 2 weeks ago...then this week recieved a letter saying they wont pay it as its all being investigated about whether the charges are unfair? Has anyone else recieved this letter? made me so mad, thought i was finaly going to get some money! thanks
If they have made an offer and you have accepted it they have to honour their offer.....I am having this exact same problem.0 -
Just before the announcement regarding test case we were in process of putting together our claim for bank charges to Alliance & Leicester.
We are becomming incredibly irritated by A&L with the amount of charges they are putting against our accounts on an ongoing basis.
For example, I have just received 3 charges of £34 (totalling £102) due to unpaid direct debits (I was £2 short to cover the DD's!!!!) - all of charges taken STRAIGHTAWAY, so I am now £102 overdrawn, which will then incur overdraft charges for £25 at the end of the month! I find this totally infuriating and unfair!.
My partner has been charged for 1 month's overdraft FIVE TIMES @ £25 (totalling £125) due to the number of days he was overdrawn (which again was caused by them taking their charges!!)
How can they get away with refusing to pay a Direct debit due to "insufficient funds", yet continue to take the charges??
Is there ANYTHING we can do to prevent further charges being taken during the test case period? I read a post that Barclays had stopped charges being made to a customer - can we appeal for similar?
We will still be submitting our claims over the next month.
Any advice would be helpful.
I've gone off A&L completely after the great feeling of the 0% overdraft for 12 months. We transferred money from our A&L personal accounts to our A&L joint account to pay the bills. Looking online it shows our money going in then all the bills coming out. Yet they have charged us for 2 failed DD's!! . The online statement clearly shows that our running balance never exceeded the overdraft limit!! When phoning to complain they say they can't talk about charges while this test case is on the go. So they can take your money but won't talk to you about refunding it even though they were incorrect!!!
Think I'll be talking to Nationwide soon....0 -
I've just called A&L about £75 charges I have been hit with on my account.
They have told me that their policy is that they are not refunding (or even discussing) ANY charges until the test case in the courts is completed. All they would do is log my complaint.
The lady said that most banks were now doing this, although I've not heard of it.
Can they do this? ARE any other banks doing it? Pretty annoyed.0
