    As MimiJane says its what the court would award you if you have to go and stand in court to fight your case :) I've loosely based it on around 25 hours charge back which is an 'acceptable' amount. But you can itemise it and see how much you can make it add up to :D If you do document it you can ask for that amount. Far easier using the £230 figure I think.

    Send them £10 and fill in the gaps there may be another £1,500 on it!
    You can also do what I did with Barclays and write to them listing the items you know about and start claiming now! Then when the statements come add up the missing months and start a second claim ;)

  • Ok just checked the staus of my claim online and I'm getting the following:

    The Defendant admits only part of the amount you have claimed. A copy of this will be sent to you with details of the steps you can take next
    </TD></TR></TBODY></TABLE>Is this a good thing or a bad thing ??:rolleyes: I lodge the initial claim on estimated charges as they didnt respond to my data protection request ( a booboo I know now) but obviously they are not liking the amount I'm claiming, but what exactly does part admission mean?

    Hi there,

    No-one can answer this for you ... it's you who has to decide. Can you afford to wait (up to 40 days) for your full set of statements and take it from there? Realistically, the whole process will probably take about 6 months (I'm into my 7th month!). You may well be surprised at how much the total amount comes to if you wait for all your statements.icon12.gif Or, do you need the money sooner and want to press ahead now, though you may well be losing out considerably?

    It's almost like asking someone ... "Do I need to draw some money out of the bank today or should I go next week?" Only you can decide.

    There's the argument, now it's up to you ...

    Start with all the statements with the charges you want to claim, or it will get complicated.

    Best of luck in whatever you decide to do. You'll get loads of help here along the way.

    Well i will wait to celebrate until i see the money in my account but i just settled over the phone with wragge - its for less than original amount so you may think its a cop out but i didnt want to wait til october to go to court and i wanted the cash ASAP

    Just thought I'd update you all with where I'm at and see if I'm doing the right thing :confused:

    I sent the original letter to A&L in May and received the standard reply of "Its in line with our terms and conditions blah blah blah"

    Sent the second letter (With a cheque for £10) asking for all my statements and these came within about 2 weeks :j

    Sent a 3rd letter detailing all the charges (around £900 with intrest) and got almost an identicle reply as the first one.

    Started MCOL and received the intention to defend from Wraggle and an offer (the same day ) from A&L for about £140 :rotfl:

    So now I'm just waiting :confused: I did receive a letter from Northampton court saying that its being transferred to my local court but not heard anything in about 2 weeks now

    Do I just sit tight ?

    Hi everyone

    I am trying to claim £2989 from A&L. I have followed all Martins instructions and I am now at the stage where I have wrote to them and said i would accept a payment of £2500. I have today received a long letter from them saying the charges are fair etc but they would be prepared to pay me £1086.50 which 'reflects the difference between the amount of charges for unpaid items actually applied to my account and the amount of charges that would have been applied to the account if the charge had been £12 (being the amount that the OFT indicated was not unreasonable in relation to credit card default charges). Has anyone else recieved one of these letters and should I proceed with taking them to court.
