My original calculation of charges to Alliance & Leicester in May was £4982.50 + interest. I am now tonight about to complete MCOL form [eek!:eek: ] and want to know if I can alter the value of my original claim when completing the form or does it have to match perfectly with previous correspondence to A & L?
This is due to the fact we have had further charges on our account since May and also I originally included the £5 monthly interest charge in my claim, which I have since realised you cannot include.
Also, we are on holiday for one week in August. Is it best to mention this on the court form somewhere in case they set a hearing date and if so where on the form?

My day in court was supposed to have been last Monday 9th against the Alliance & Leicester, but because i was out of the country last week i was given advice by my local court. They advised me that my case would not get to court as none against any bank had at that court, and therefore advised as security just to submit a letter by way of statement which if required would be read out in court on my behalf.
But found out today when returning that the alliance & Leicester didnt bother turning up either and because neither of us were there the court decided to adjourn my case for 28 days!!! WHY??? IM WORRIED NOW!!! HELP!!! PLEASE!!!0 -

Good luck and let us know how you get on. I'd recommend you join up on the CAG (Consumer Advice Group) forum, where you'll get loads of useful advice from some very experienced and friendly people. You'll have your own thread, so everything will be personal to you. They've helped me out no end (as well as this site of course!) :-

Hi there, I am new to the forums and just wanted to let you know how far I have got with A & L, both my Dad and I have sent letters on 05/07/07 and he received his reply on 12/07/07 and I just received mine 17/07/07, exactly ther same letter was sent quoting the Office of Fair Trading going off about Credit Card Fees, which I never even mentioned in the first place, which just proves that it is an automated response to shut us up. The only mention of my claim is them quoting "making our customers aware of our fees when opening accounts, and feel that we have not been unfairly charged so will not refund my fees". However I then sent the second letter from Martins template threatening Court action for both our accounts and havent yet had a response. So will let you know the next step as it happens.

Well done, you sound as if you have everything in handJust make sure you don't start court proceedings before 28 days of first asking them to refund in writing.
Expect a long drawn-out process if you're going for amounts above £,000. My claim's still ongoing and it started last DecemberSee my recent posts with links to the Consumer Action Group.
