I have had the same problem I posted my letter on the 1/07/2007 and was not sent to the bank till the 12th july. I phoned the financial ombudsman today and was told it cantake up to 6 wks to get money refunded into your account what a bummer0

A&L have offered me £369 which is around £900 less than what I was claiming. I have recalculated and taken out the monthly £5 OD charges and my 'court figure' is around the £1000.
My second letter (threatening court action) went on 25/6/07. I gave 14 days notice before court action stating I would accept £900. Is it time now I started the court process in small claims court?
Just looking at the post above and timescales. I should also point out that my first letter was sent on the 6/6/070 -
Nappy, my view is that you've come this far ... you're almost certain to get your extra £400 if you carry on; it's a lot of money. Even if you do have your "day in court" (doubtful), sure, it'll be nerve racking for a short while, but you'll get ALL of what you're owed.
I know some people near to their court dates are settling for less and, in a lot of ways, I can't blame them, especially if the thought of court fills them with dread and, on weighing it all up, they'd prefer to take a lesser amount. The fact is though, it's unlikely to go to court and a lot of settlements are happening very near to the court date, if not on the actual day.
It's your choice of course but, ask yourself this : if you don't continue, will you live to regret it?

yes i have rang wragge today and they have said that their offer stands and no more, they said that im not entitled to any interest and it will be the judges decision if i get any, but wragge are not allowed to add the interest to the amount that i am claiming,
Is this true!!
I said no to their offer, and that iwould be going to court on thursday, she just said thats fine!!
Have i done the right thing, does that mean that my offer what they have already offered me, will this no longer stand.

I havent had to pay any fee to the court only my court fee of £120 which wragge are giving me back,
Wragge told me today that they are only entitled to pay back my claim and no more, they said im not entitled to the interest and that will be the judges decision!!! Not sure if this is true or not!!
So here i come Thursday my day in court!!

They're talking out of the b******es! Everyone's entitled to 8% statutory interest if they file court proceedingsIt's all designed to frighten you in accepting their offer, so take no notice, they're devious and nasty and will say anything to try to get you to settle for less!

Nappy, self litigation is us fighting the banks on our own, i.e. WITHOUT a solicitor (whereas they have one).
When they are about to settle, you can apply for "wasted costs", which basically means you MAY be successful in claiming £6.75 for every letter you've sent and £9.25 for every hour you've spent in the claiming process. It's recommended you work out a schedule detailing what the letters are for (i.e. preliminary, etc.) and give a "conservative" number of hours for your preparation, e.g. 30. You can then ask Wragge to add this figure onto your settlement figure, they say "no" and you then send a suggested Order to the judge.
Best to keep all receips/Recorded Delivery slips, etc. and attach these also.

Note in the above, they had their preparation hours cut down to 10 hours from 30, but still got reimbursed by a fair amount.

Of course ... as long as they pay out in settlement, you've "wasted" time and money so, yes, try and claim it. I'll probably try for 30, or if I'm feeling very brave, 40 (which is a true reflection), but would never expect anywhere near this.
You don't know what your costs will amount to until more of less when the money is re-paid to you ... you could be writing to Wragge 'til the last minute, so the idea is you leave it until settlement is agreed and then ask Wragge primarily (not the judge until Wragge say say "no"). You have to be seen to be going down the correct route
By the way, I keep adding to my wasted costs schedule (as more letters get sent) ... up to £400 plus at the moment. I'd probably realistically hope for half that at the end of the day.

HI
I'm new here so please be gentle. I am familiar with the process of reclaiming bank charges as have lurked for a while but not yet posted:mad:
Anyway I am looking to claim my bank charges back from A&L I have some of my statements going back to 2001 but not all of them, ie I have some months for some years but not all month and also i have all of 2002 and 2003 missing??:mad: :mad:
I am pondering on whether or not to send the 10 so they can send me a copy of all the statements for the last 6 years, however the total charges on the statements i already have total 1545 which i would be more than happy with.
So the question is - do i send off the 10 and wait however long they take ( which seems to be a while with A&L) for them to send me all the statements, or do I cut my losses and just claim back the 1545 which is on the statements which I already have as it will be quicker???
Please help me decide or advise if I claim back the charges on the statements which I already have and they agree to refund these would I then be able to ask for the 6 years statements to claim any charges which I hadnt claimed in the first instance:mad:
