    Oh No! I've just written directly to A+L Complaints and W&C Senior Partner complaining about last few letters and sent copies to FO and Solicitors Regulation Authority for good measure :) with copies of BBC News article and court papers stating its in court on the 21st August ;)

    This is my 1st post and I've tried searching for the answer to this question, if it's already been answered-apologies! :D

    I bank with Alliance & Leicester and have been charged a 'monthly overdraft charge' ranging between £5 to £10 on many occasions - can this be claimed back??

    Also, can I claim back for an 'overdraft arrangement charge?

    I don't know whether the above charges come under service fees or monthly account fees.

    I've read many differing reports about whether or not you can re-claim the monthly overdraft charge ... strictly speaking, no, you're not supposed to claim for them, BUT I believe some people have been successful in claiming the charges above £5 (i.e. £10 and £25). I'd be inclined to include these (I didrolleyes.gif). It's not the end of the world if you don't get them back ... they still owe you a lot of money and it will just be deducted on settlement.

    Have had an account that went overdrawn by under £2 and they started piling on the charges, up to nearly £200 in no time. Had a threatening debt collection letter etc. Haven't spoken to them for 2/3 months and last time told them to keep on charging as I'd claim it back anyway, which was just irrisponsible bravado on my part due to the irritating person I was talking to.

    Going through the paperwork/bills tonight and surprise, surprise they have refunded all charges to take balance back to 0.00 (so I'm a couple of quid up). Glad I didn't pay them.

    Have they decided that it would be unsuccessful to take someone to court for such horrific charges? Or are they just a very kind, caring company who employ commonsense to take good care of their account holders? Someone has clearly made a decision somewhere along the line.

    Anyone else had this?

  • I am currently trying to claim back around £1000 worth of unfair bank charges from A&L, I have used moneyclaim but they are defending the claim they have sent me a letter basically saying that because its a current account the charges are fair and that the Office of Fair Trade are looking into the matter, they have however offered me around a hundred pounds as a sign of good will.
    Has anyone been in this position and what do I do next?, with the bank defending the claim I'm obviously shaken and don't know whether to continue .

    I am currently claiming £6500 worth of charges from A & L, they have used the same trick with me, dont worry they are just trying to put you off :rolleyes: , they have also used various other tricks to try and put me off, but dont be swayed, stick to your guns - you are in the right not them, just keep going and believe in yourself - you are in the right. I am due in court on the 25/7 and it has been a long hard slogg but will be worth it in the end.

    Hi all,
    Am due court thursday 19th, had offer through of my settlement, got all my claim back minus my interest, which is nearly £400, not sure what to do, shall i carry on or is that being too greedy, ive done so much work for this with lots and lots of help.
    Please advise, im tempted to carry on,
    I spoke to the court on friday who were very helpful and who said that its all successes with claiments and no banks are turning up,

    Nappy, my view is that you've come this far ... you're almost certain to get your extra £400 if you carry on; it's a lot of money. Even if you do have your "day in court" (doubtful), sure, it'll be nerve racking for a short while, but you'll get ALL of what you're owed.

    I know some people near to their court dates are settling for less and, in a lot of ways, I can't blame them, especially if the thought of court fills them with dread and, on weighing it all up, they'd prefer to take a lesser amount. The fact is though, it's unlikely to go to court and a lot of settlements are happening very near to the court date, if not on the actual day.

    It's your choice of course but, ask yourself this : if you don't continue, will you live to regret it?

    Yes! They have cleared £200.30 of charges and interest to take the balance to zero but they have also removed access to my account! So I’m claiming £200 compensation for removing banking facilities from me! :rotfl:
