Hi all,
Am due court thursday 19th, had offer through of my settlement, got all my claim back minus my interest, which is nearly £400, not sure what to do, shall i carry on or is that being too greedy, ive done so much work for this with lots and lots of help.
Please advise, im tempted to carry on,
I spoke to the court on friday who were very helpful and who said that its all successes with claiments and no banks are turning up,

I need to clear up a few points on reclaiming bank charges, firstly I would like to thank Martin and the rest of you guys for such an informative and socially just site.
I wrote to Alliance & Leicester requesting my last 6 years default charges as per martins template. They failed to respond at all within the 40 days, I then wrote a letter asking again, still no reply.
I began action at moneyclaim a little while ago, however I estimated the my claim at 5000 quid including interest and costs, this because I had not been supplied the relevant information to make an accurate assesment.
I have now received an offer of 724 quid from A&L, however I'm starting to worry as I dont actually know for sure what they owe me, I know its more than the offer, what do I do next? I am writing to them today refusing the offer as without my statement data I cant accuratly asses there offer ( hoping this gets me a disclosure ) I have never done anything like this before and find it all a bit confusing and a little daunting, any advice gratefully received.

Generally it's a bad idea to estimate your charges. Should you need to prove the amount in court, you will have no evidence.
You might get lucky and find A&L provide this evidence for you, but don't rely on it. Keep badgering them for the charges and report them to the Information Commissioner for non-compliance.
Have you been sending correspondance by registered post? Can you prove they received the letters?0 -

I have already complained to the information commisioner who apparently is struggling with a backlog on this subject but is going to get in touch with A&L, and yes I have sent everything recorded and kept copies.

I am having the same problem and do not know which letter to send next.
I sent my cheque for £10 dated 23/3/07 and they cashed it 20th April. they promised me statements by 5th May. I sent reminder letters, made phone calls - nobody rang me back or replied until I opened a premier current account online and sent a secure message did they finally respond two weeks ago. Got the statements calculated the charges and sent them a list of the charges and a letter asking for it all back £757 plus goodwill gesture (for not sending my statements within 40 days of cashing my cheque) - guess what they sent a letter within 7 days the same as your letter.
I want to go straight to court to get the money or should I send the next letter giving them 14 days to respond??Mortgage Free 2016Work Part Time:DHouse Hunting In France 20230 -

Just spoke to wragge, they upped their settlement offer by £500 since friday, but its still not good enough for me... holding out for more.A&L - 1st letter requesting money sent 22/03

You have to send the LBA (letter before action) ... see Martin's template letter. You cannot claim before giving them a full 28 days from when you first ask for your charges back in writing, or A&L would get your claim struck out.

I received a letter from the FO to say the bank want to settle this dispute outside court and i could have my full claim back if i signed a form and sent it back to the FO.
I have just called my bank to find out when i will be receiving the money back and they said the FO had not been in touch with them.
Anyone got any advice?
Or know how long it is going to take?
My bank is Alliance and Leicester - possibly the worst bank in the world!0
