The banks have been warned that they are NOT to quote the Berwick v. Lloyds TSB case and A&L have "apologised" to claimants for doing this. Wragge, it appears, STILL CONTINUE TO DO SO! There are BBC articles re. this stating what the banks have been quoting and how they must cease to do so.
By the way Loz ... you haven't included your daily interest rate

In my view, you have to spell everything out to them (time and time again
), or they'll get away with whatever then can. Within the nudge letters on CAG, they advise you give a full breakdown of everything, including the daily rate, and then propose you apply for "litigation costs" when they've agreed to settle. This entails giving a full breakdown of every letter sent (preliminary, nudge, etc., etc.), stationery used and preparation hours ... again giving as much info. as possible. Did you just submit a figure? If so, this wouldn't mean anything and could just have been "plucked out of the air".
If Wragge say "no" to reimbursing litigation costs (which they normally do of course), you're then entitled to pursue this through your local court, but you'll be highly unlikely to be successful without a detailed schedule and as many enclosed receipts as possible to prove your expenditure.

Hi, I have just got back from the court yesterday I have to go back in September cause of the banks terms and conditions ( A & L ) they will need to give a reason for all the charges ( £25, £34 etc )
the court was very nerve racking
Also i have a joint account and it was only me that was there
I will be going to see the in court advice service next Thurs,
The same day i got the Wragge & Co letter in i got a cheque in from A & L for quarter the amount for which i rejected.
It is not that easy when your in court trying to get all the letters i sent and also the letters they sent + all the charges all the lawers coming in and the judge and his wig it makes you feel like i have done something wrong so hear to another go in Sept ,this is an ongoing thing since Feburary fingers crossed.:eek: :huh: :eek: :huh: :eek:

I have been reading this site for months now and I am stuck on my court bundle. So far all I have is my statements, letters to and from A&L and my interest spreadsheet. I have tried to look on CAG site but to no avail. Do I have to buy a book?
My court date is 21st August, I am claiming £2300 including court fees and interest. So far they have only offered me £560. Which of course I declined. Is it worth me writing to Wragge and Co with an offer.
I really am dreading going to court.

Have you started your own thread on CAG? You'll get loads of advice and info. this way as you'll have your own personal thread.
There is also a court bundle thread on here, where you'll find lots of info. Do a search for Court Bundle.
It's impossible to give you any advice I'm afraid unless we know exactly what "Directions" the judge has given you in his Order. It's very important therefore that you post it on here and/or the CAG forum. This is my 1st post and I've tried searching for the answer to this question, if it's already been answered-apologies!
I bank with Alliance & Leicester and have been charged a 'monthly overdraft charge' ranging between £5 to £10 on many occasions - can this be claimed back??
Also, can I claim back for an 'overdraft arrangement charge?
I don't know whether the above charges come under service fees or monthly account fees.

I received a second offer from A&L yesterday for exactly half of the £1065.50 that I'm claiming plus my £120 court fee. This doesn't include any interest that I'm claiming
The letter states:This offer is made on the basis that you accept our clients terms and conditions of your account previously notified to you and that charges will be applied in accordance with their current charging policy.
I have emailed Wragge & Co to decline this offer and made a counter offer of 85% + court fee which i would be happy with. if I don't get this though I will be waiting for my day in court.0 -
