Just thought I'd update you all with where I'm at and see if I'm doing the right thing

I sent the original letter to A&L in May and received the standard reply of "Its in line with our terms and conditions blah blah blah"

Sent the second letter (With a cheque for £10) asking for all my statements and these came within about 2 weeks :j

Sent a 3rd letter detailing all the charges (around £900 with intrest) and got almost an identicle reply as the first one.

Started MCOL and received the intention to defend from Wraggle and an offer (the same day ) from A&L for about £140 :rotfl:

So now I'm just waiting  I did receive a letter from Northampton court saying that its being transferred to my local court but not heard anything in about 2 weeks now

Do I just sit tight ?
Yes am afraid it is just a matter of being patient and waiting, frustrating it can be, but worth it.
Im due in court tomorrow, after having started this in jan.
You will get offers along the way, but it is entirely up to you as to whether you except them or not.
I havent, but i have lots of very good help and support along the way to help me with my decisions.
You will get notification of transfer to your local court, then after that you will get a date, included will be instructions from the judge as to what is needed from you.
Having gone through this stage obviously, it is very varied as to what each judge wants, mine only wanted statements, and details of dates and list of charges, but i did add more to this, i know others have had to submit more to to the court, but i wouldnt worry about that for now,
its up to you how far you want this to go, you will get your money, but only if you have the time to hold out for it.
Will let you know how i get on tomorrow.
There are great people on here who will help you all the way,

Thanks for the reply Nappy ! I'm not in a huge rush for the money so think I'll hold out for the whole lot (including intrest)

the funny thing was that I didnt think I had been charged so much ! and when A&L did charge me £50 for going £8 overdrawn I called and asked them to refund them... They wouldnt and were quite rude on the phone so I said 'you can either refund the £50 now and we say no more about it or you keep the £50 for now and I claim 6 years worth of charges + intrest' to which he replyed 'Go ahead and see how far you get' :rotfl:

Good luck in court tomorrow I will log on and see how you got on ! whens your slot ? and are you going to call Wraggle today and give them one last chance ? :p

    Hi.

I received a letter today from wragge and co. it states:

We refer to your letter of 14 June 2007.

You sought to accept the cheque which our client has sent you, in the sum of £331.50 as a partial settlement of your claim.

However, this option is not available to you. The cheque was not sent to you on the basis that it could be cashed by you on account, it was sent on the basis that it is in full and final settlement of your claim.

You have cashed the cheque, indicating your acceptance of that payment, and your claim is therefore now concluded by settlement.

We would be grateful if you would confirm that you will now acknowledge to the Northampton County Court that the case is concluded by way of settlement; alternatively we will make an application to strike out your claim going forward as it has been concluded by formal settlement, and seek the costs of that application from you.

Accordingly our offer letter of 11 July 2007 should be disregarded.

I've just got off the phone to W&C asking where they got their information from that the cheque had been cashed as i still have the cheque in front of me. Obviously they couldn't answer.

They told me i need to send the cheque back to them so that the claim can continue and the second offer of £532.75 made on 11 july 07 was still on offer. I told the person on the phone that i had already refused this offer.

have today received my court hearing date, 23rd October 2007. I am now quite nervous as I didn't expect it to happen. Any ideas of the likely outcome?

Will A+L pay up before the court date?

Or will I have to go to court, if so any hints tips please!?
    Work hard play hard......

They're out and out liarsrolleyes.gif They've even been known to ring some courts last minute and claim (wrongly) that their cheques have been cashed in order to stop proceedingrolleyes.gif
