    And i never mentioned to the judge yesterday about "wastage costs" i thought best not push my luck, i just ran out of the court!!
    Am i still ok to send my costs off to "wragge" even now, that i won!!

    Send your wasted costs schedule out as soon as poss. Nappy before they send you your cheque. Copy in the judge and, if they then don't agree, send it to the judge and copy in Wragge.

    It's all happening today ... Wragge been in contact. Will report back later, off out now.

    What do you mean copy in wragge, copy in judge, and if wragge dont agree, send it to the judge
    Its just the copy in judge bit i dont understand, or maybe im reading it wrong, good luck with whatever and do report back

    I have just recieved a letter from Wragge & Co offering me £982 plus court costs as full and final settlement. My original claim was £1785 plus interest and costs.
    I am about to ring them to decline their offer, but I think I am going to let them know that I am willing to accept my original claim without interest.
    What do you think?

    Send a letter to Wragge asking them to pay your wasted costs, as per this link :-

    Copy in the judge so that he knows you're going through the correct channels and asking them first.

    If/when Wragge come back to you and say they're not prepared to pay you any extra, write to the judge with the draft order in the link above, politely requesting him to order Wragge to pay you the money. Copy in Wragge on this letter, so they expect the order from the judge.

    As mentioned before, the judge is highly likely to cut your hours down. I've read from a solicitor's post somewhere that the most you can get for wasted costs if £80, but I've read on the CAG forum where someone has got about £300, so go for it. It should all be in the link above.

    I've just remembered i have my cheque for £494 from A&L which they sent in settlement of my claim.....i didnt accept this and wrote back to them saying that i would accept it as partial payment only.....i never got a response to this and im now waiting for my day in court (17.9.07)

    Can i cash this cheque or am i not allowed to/will it ruin my chances of getting the full amount...??

    It seems silly just sat heer doing nothin....

    Opinions greatly received xx

    Hi there,
    I sent my cheque back with a letter saying that i wasnt accepting, i think reading through the threads that people who have cashed the cheques that have been received, this has given wragge the perfect opportunity to reply by saying that the case is now settled, because the cheque has been cancelled and this has invalidated their claim!!
    So my personal opinion would be to sent the cheque back by recorded delivery, and keep your receipt, so wragge cant say that the cheque was never sent back, i personally wouldnt give them any opportunity, how small, to say that you have done wrong and then ruin your claim,
    But the choice is yours as to what you do,

    You'd be losing out on a lot of interest! Personally, I'd hold out for the full amount and decline their offer. Have you got a court date yet? If so, expect another offer nearer the time. They DON'T want you to go court! (See Nappy's post above)

    I looked to claim £205 from Allaince and Leictester and have now been sent an offer of £44 with a letter saying that this is a ex gratia basis and offering me what it would be if it were £12 which apparently what the financial ombudsman are suggesting? But I don't know how that works out.

    I know £205 might not seem alot but I'm a student so it all counts, £44 to me seems pitiful...could people please help!

    Be like me and stick it out! I believe I have £4500 due, Bank have offered me £3500, have county court date on 25 July. If it was £450 and I was offered £350 I was still dig my heels in. Why eat baked beans when you may be able to eat beef for a couple of months if you get the full amount back?
