    Excellenticon7.gif This is the same order for the defendant as I've had and, guess what, they can't respondicon10.gif Basically if you get your bundle in by the date specified and they do not respond to you ("serve") and/or the court ("file") by 14th September, you win by default and get the full amount.

    "No further order" means the court will NOT extend the amount of time for the defendant to get their court papers in by sending out another order.

    I'm at the stage where I've sent a letter to the judge asking for judgement by default, as Wragge didn't reply by the end of June. Sent the letter three weeks ago and court date's in just over a week! Apparently the court are desperately busy and will let me know next week if the judge will just order them to pay without it going to court, or he may still want to take it to the court room, see me and a number of others, and make his order then.

    Whatever, hoping this means I'm home and dry.

    Wragge have made me another offer (last week) of 70% of the original claim, but have not included the 8% interest and the AQ fee I've paid, so they can stuff it, rejection letter on the wayrolleyes.gif I won't say I'll see them in court though, 'cos there's no way on god's earth they'll be thereicon10.gif

    Ask any questions on the CAG site, start to prepare everything and I'd submit it about 4 days before it's due in ... bearing in mind you may well need to keep adding to it (I didrolleyes.gif).

    At the end of the day, it is your decision, but i would definately go for the amount that you are claiming, any problems please dont hesitate to ask, there are enough of us here to help, good luck and keep us informed

    Fingers, toes, everything crossed that the decision from the judge next week is the right one and you dont need to go to court,
    Thats something else the representive from Wragge said, he thought i was claiming 8% but i only claimed the statuory interest, that was all i added on my schedule. Can i ask because i went to court, should i have worked out my interest at 8% and then told the judge, not that i am bothered, was just wondering. Or should the judge have awarded me the 8% interest, i definately used the template letter for the "statuory interest",

    A little help required from those that have been in touch with Wragg.As some of you may have read i have my court date next week, i've rang Wragg and Co to confirm they have received my court bundle but no one has been able to do this with me each time i've called, they have said someone will call me back (which hasn't happened). I was wanting to use this call to ask them if they would like to settle before court.Can anyone suggest/recommend a name or number i call at Wragg to get this resolved??Thanks all xx

    Hi there, you're a little in front of me ... I'm due in court on the 1st!

    I had exactly the same problem and rang a few times. Eventually got someone who knew what they were doing and said "yes" they had received it. If you have a Recorded Delivery slip, you needn't worry. In the eyes of the court, correspondence sent this way is seen as having been "delivered" within 2 days.

    I'd speak to the person who sent you your defence, so the number will be on their correspondence. They've just "upped" their original offer to me, so it's now the charges amount and court fee, but no interest or AQ fee refund, so told them to stuff it, unless they want to send the full amount pronto, plus daily interestrolleyes.gif

    Just rung the court (againrolleyes.gif); she couldn't find my file and had to ring back after asking the the judge what was happening. Apparently have to "apply for judgement" and sign a form which should be in the bundle somewhere. The judge said it shouldn't have to go to court as the "other side" didn't comply with his instructions.icon10.gif

    Must hunt this form down now, thought my letter would suffice and it's taken them 3 weeks to tell me this! If I hadn't of kept calling, I'm sure it would have been a wasted trip to court.rolleyes.gif
