    Hello everyone, I have only posted once on this thread but I have read it a lot and it has been really helpful. I just wanted to post my outcome on here in the hope that it might offer some reassurance to other people.

    I was due in court for my preliminary hearing this morning at 10am. I was sitting waiting very nervously when a representative of A&L turned up (i am assuming from Wragge.) He asked me when was the last time I had heard from Wragge or A&L, I said not in weeks. He said that they wanted to offer me £993.50 which I accepted as I was only claiming £1021. The reason they gave for this was that it was minus interest claimed and this was because if you put the money in a bank account it would not pay the statutory 8% interest claimed.

    I asked him if he was going to give me anything in writing to confirm this. He said that he has been instructed not to. When I asked him how I could be sure that A&L would not back out on the deal he said I would need to go in and talk to the judge and he would arrange something.

    When I spoke to the judge he said he was going to produce an order that said that A&L was to pay me within 28 days, if they did not then he would give me a further 28 days to ring the court and they would re-open the case for me, this should prompt A&L to pay. If they did pay then I don't have to do anything when the time has lapsed the case will be closed.

    I hope that this might help somebody especially those people who have prelims coming up.

    Sweety 83, that's great, i'm grateful for you post as i have my prelimary hearing next week, i'm trying to get the amount plus court cost less interest but wragg and co are not being very helpful, i want them to agree to this before the prelimary hearing next wk xx

    maybe not.it seems its an overdraft charge for a facility.ask your bank what it is but expect it to be a account charge.good luck getting your money back.

    Thanks mimijane for the info you emailed me. wraggs have sent me another letter today offering full settlement less interest (which is what I asked for on Monday and which they declined). As I was only asking for £218 interest I am going to accept this. However, I will still be visiting this site as now I am going to go through it all again with A&L on behalf of my daughter then I will take on Nationwide for my son who has let him go overdrawn on his basic account (without a overdraft facility) and then wapped him with charges.
    Thanks everyone for all your help I would have given up long ago if it wasn't for this site and although I did't always understand what was being said it always seemed to be explained the more you read. I wish you all the best and if I got my money back then I think anyone can.

  • :T Hi,just to let you know i was due in court on 7th August.Was claiming £1400 incl interest and court cost.Had an offer today off wragge & co for £1226.Going to accept as i would lose a days pay to go to court so im happy with this.I have to sign to say i accept a&ls terms and conditions in future.Thanks for all your help couldnt have done it without this site.

  • Alliance and Leicester have followed the pattern for us as others I've read. They sent us an offer of a third of our £1800 claim (inc interest) at the same time as the solicitors letter saying they would be defending in court.we followed the advise of all you guys and politely sent back the cheque. the court changed from northants to the local one but the judge decided we didn't need to fill in the questionnaire. but now we've been told to send £100 and to send our claim details to the court and alliance no later than aug 1st (lots of time !) Martin Lewis step by step guide explains that not one bank has gone to court (and many claimants are then made bigger offers) and the court makes the bank pay up. the problem is the guide has no advise about what should I be sending to the court/alliance? Some of you refer to your court bundles. Is this the same and could someone please give me a list of whats needed. is it just my list of dates and charges?

I did take the precaution of opening another account with a different bank but it looks like it wont be needed after all so dont worry too much on that score.     hello ,just got round to going through with my claim on mcol yesterday[dont accet visa electron so had to put the £80 in my moms account to pay with her card]
    been trying to sort things out with alliance and leicester who have responded to all the letter templates ive gratefully used off here up to a month after the time limit to respond with the same response i.e NO CHANCE! and a leaflet explaining the charges .i didnt want to do the court thingy and woulve liked to have asked them why why my claim is unjustified when theyve paid so many others back .
    was reluctant to go to court as my brother pointed out that my luck is terrible and that id probably be the one who ended up getting getting turned down in a county court and setting a precedent so everyone else would hate me heehee
    anyway total claimed with interest and court costs about £950 ,does anyone know how long it takes for them to receive the papers and the whole process before i get turned down again -as the anticipation is killing me? any advise gratefully received!
