I have had a letter through from A&L offering me £3250 which they owe me over 10k. I wrote a letter back saying they have insulted me and I will wait until the courts have made a decision however, a letter came today from A&L solicitors saying they will be defending the claim hence I have joined this to see what I should be doing next??? Adice would be greatly appreciated0

As it is a bit late my brain has switched off. Have you actually started proceedings in the court and if so what stage have they reached.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0

accepted wraggs offer 4k claiming 4500,they sent me the offer dated 27th ,happy days, im out on the town tonight thought i would have to wait until after the high court case.HAPPY DAYS ARE HERE AGAIN

i have just got from my local court an ALLOCATION QUEATIONNAIRE but i think i need a little help.
a. do you wish any further action in this claim to be postponed........NO
b. location of hearing to be at another court other than my local..NO
c track small claims (£1200) ....YES
d.witnesses(here i dont know what to put as i am doing this for my wifes account??????)
e. experts do i want permission to use an experts repoert at th hearing? (do i?) if so ?
have i already obtained an experts report?
do i want an expert to attend if so why
f. hearing my wife can go to any date but i cant as i am on jury service soon
g other information what goes in here

So I wrote a letter yesterday saying that I thought this was an insult and if they gave me 7k we would close the matter. I got home yesterday to find a letter from their solicitors saying they will be defending the claim. What do I do now? Advice would be appreciated0

The ball is in A&L's court wait and see if they actually lodge a defence. If they do not lodge a defence in time then apply for judgment in default.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0

Hi All, i know i posted in this thread yesterday and some where awaiting on the outcome of my preliminary hearing. I had my hearing this morning against A&L, the bank did not turn up to defend and the judge was lovely, he even worked out extra interest i was entitled to as i had only calculated up until the date i filed my claim in April. He ordered that A& L should pay me the full sum within 14 days. The judge was lovely, i was nervous about any questions he may ask as i didn't know what to expect, but i didn't have to answer anything, i don't think he was too happy at the bank wasting his time. He did ask though if i had been in touch with a&L and i told him i had tried to negotiate with their solicitors but they told my their client did not wish to settle.Don't give up and let recent media cover put you off, i was so nervous last night and this morning but it was all worth it in the end, (well i will be waiting to get that cheque before i really celebrate - they have 14 days in which to pay my the full amount claimed, which is just short of £3.5k)Thanks for all the support on this site xx0

I don't know of one person who's come away from a preliminary and not been happy with the outcome. It's all so nerve wracking beforehand though as we all think we're the one who's going to get the "nasty" judge and be asked loads of questions we can't answer
I've not attended one myself, but have read of lots who have.
I'm awaiting a cheque direct from A&L right now and the court hearing is tomorrowNot worried though as Wragge have sent a letter saying A&L are prepared to settle in FULL
Cheque's on the way direct from A&L (normally goes through Wragge first) and of course the postal strike has delayed it. They keep ringing to ask if I've received it, so desperate to avoid court
Also applied for judgement by default weeks ago as Wragge never submitted their bundle, so it should be "in the bag" if I take their letter along. Just a nuisance having to prepare to go to court, when it's a complete waste of time on everyone's part
Perhaps the cheque will arrive tomorrow a.m. ... hope so!
Hopefully all this will make the judge angry enough to award Wasted Costs

Thanks Mimi, i kept calling wragg to see if they would like to settle minus the interest as the thought of court was daunting but they said they were unprepared to as it was only a preliminary hearing today. I'm now glad they didn't cause i've came away with the interest plus the extra the judge calulated for me. Thanks again for all your help mimi and everyone else, so glad it worked out ok (just hope i get the cheque - that's when i will really celebrate) xx0
