    I started the court thing with alliance and Leicester on 10th may 2207, now have court date for August 17th, but going to court today to enter a judgement, because they haven't filed their papers within the 21 days require. So hopefully that means we win by default. A & L are pretty quick at doing paper work, up until now, compared to lloyds who are really slow......

    If your unsure about the court route, go with financials ombudsman, it free, takes up to 6 months, but I believe most people are getting the difference of each charge being charged at £12......

    thanks,im hoping they dont respond within the allotted time ,i have to say theyve not responded to any of my letters within the timelimit -the last one i was waiting 6 weeks for instead of 14 days .anyway good luck today ! really hope it goes your way
  • wrote off to goldfish asking for just over £1,000 in charges they have wrote back offering £272 they say this is the difference between £20 and £12 which is a lawfull amount to charge what do i do now:eek:

    This seems to be protocol now for A&L, they offer you a small amount to begin with, hoping you will accept, then another offer will come through which may be £400-£500 more than your 1st offer,
    Read my message on page 89, i refused both offers before i was offered my whole claim minus the interest, this final offer was made to me 4days before i went to court,
    It is worth sticking it out, you will get all your money, it all depends how patient you are and if you need your money asap.
    My claim took from start to finish 6months, but worth it in the end and it did include a day in court for me,
    I won £2059 and interest (just over £400) and my court costs of £120,
    The decision is yours, but all the help and advice you need is here, just ask away, i did!!!

    Hi, I'm claiming £750 from [EMAIL="A@L"]A&L[/EMAIL] and have had an offer of £123. obviously I declined but having read all the nightmare stories I have decided to go down the ombudsman route.I have read Martins advice about doing this, but nobody seems to write anything on the forums about this. I know that it may take longer but I didnt want the 'wragg' problems. Has anyone got any advice. Should I have just bitten the bullet and gone to court?

    £12 is NOT a lawful amount, it's just the amount the FO recommended. As long as no bank or credit card company tells us how much it actually costs, you can go for the full amount. Tell them you will only accept this as part payment without prejudice and will claim for the rest in court.

    Hello guys !

    I have just received a letter from Southampton County Court (My local court!) and I'm not sure what I'm supposed to do exactly :confused:

    This is what it says (word for word)

    DISTRICT JUDGE AINSWORTH has considered the statements of case and allocation questionnaires filed and allocated the calim to the small claims track.

    1. Case allocated to the Small Claims Track

    2. Claimant to file and serve within 14 days of service of this order an itemised breakdown of all charges claimed by him giving the date and time of each item.

    3. Defendant to file and serve within 14 days of service of this order a statement setting out all facts and matter relied upon that the charges are fair and reasonable.

    4. Refer back to the District Judge after 21 days

    The court must be informed immediately if the case is settled by agreement before the hearing date.

    Date: 24 July 2007

    So I guess I just have to send a list of the charges and dates to the Court and A&L and not a court 'bundle' :j

    Do I have to send the list to Wragge as well as A&L and the court ? and why does my letter not have a court date ? :confused:

    Lucky youicon10.gif Yes, all you have to supply is your full Charges Schedule within 14 days of the date of the Order to Wragge (not A&L, Wragge act on behalf of them) AND the court.

    It's highly likely that the bank/solictors won't submit anything in reply to this as they've never yet declared how they reach their charges ... they can'trolleyes.gif

    As soon as the 15th day arrives and, if they haven't submitted anything to you, get a Judgement Form down to the judge (link below) with a covering letter and a Wasted Costs Schedule, if you want to submit one (link also below). You'll now have plenty of time to prepare everything :-

    Re. the form above, if you've paid an AQ fee, include it in the Court Fee section and don't worry about Refs. for claimant and defendant, leave these blank. Let me know if you have any other queries with it.

    You should hear back from the judge after the 21st day, at which point he should let you know of his decision. Hopefully, you'll be home and dryicon7.gif

    Strange there's no hearing date, as he mentions "the hearing date". Sounds like they've "forgotten" to put it inrolleyes.gif Suppose you could ring them and point it out to see what they say, though doubt very much it will reach court.

    Let me know if you need any help with anything ... just submitted all this to the court myself and waiting to hear.

    doesnt look llike ive done the right thing afterall looking at the news,as usual my tming is as crap as can be andive lost another £80 no doubt to alliance and leicester .feel like crying now
