Cheers Mimi, i'm actually the day before you, i'm gonna hold out for the full lot, nappy's success story has helped me a lot in the going to court saga.I will give them another call and just be persistant, i'll keep all posted on my progress xx

Just rung the court (again); she couldn't find my file and had to ring back after asking the the judge what was happening. Apparently have to "apply for judgement" and sign a form which should be in the bundle somewhere. The judge said it shouldn't have to go to court as the "other side" didn't comply with his instructions.
Must hunt this form down now, thought my letter would suffice and it's taken them 3 weeks to tell me this! If I hadn't of kept calling, I'm sure it would have been a wasted trip to court.
I do hope you get a result soon, you seem to be doing lots of phone calls and "running around"

I am really scared in case I've got it wrong and Wragge are going to haul me over the coals in court and I'll end up with nothing. Still nothing ventured nothing gained. I'll be thinking of all of you that are in court before me and a big thanks to all those that have led the way for giving me the courage to take them on.

Not sure as to what you are claiming as to whether or not your offer is near to that amount!!
You will get offered your full claim without the interest but with your court costs, as i was!
I went to court thursday 19th i was made an offer on the saturday before the thursday i was due in court offering me my full amount of £2059, plus my £120 court costs, as i was also claiming interest of nearl £400 i went to court, i got the full amount, interest, court costs etc, read my message on page 90 (IT IS A BIT LONG) but is worth the read to help you decide, i would go for the full amount if i was you, it is worth sticking it out, if you can, but that is only my personal opinion, if you want to accept what you have been offered, do that, but it is worth the wait, if you can

Shouldn't have to go to court if we act quickly ... court not being much help. Apparently have to fill a form now (though letter sent 3 weeks ago applying for judgement by default!). Only learnt this through constantly pestering them

I am claiming £1276 + £215.65 +£120 court costs. In may Wragge sent me a cheque for £328.50 which I accepted as part payment. On Saturday they sent me a letter offering me £583 + court costs. I phoned today to say I would not accept this offer but would accept charges without interest but the guy was quite offish so I'm now going to court for the whole lot. I am scared and getting myself into a bit of a flap over what papers I have to send to the court and Wragge and where to find them all. This is putting doubt in my mind, maybe wragge know something I don't. I really appreciate all the help I get from this site.

Personally i would wait and claim what is yours, but at the end of the day it is your decision, i didnt have to submit much to the court, only statements and my schedule of charges, but i did submit a little more, just to make it look like i was serious about what i was doing, and whatever you send to the court must go "Wragge" also, so at least they know what work you have done, (thats if they read the file). I know it may seem a bit of "leg work" to do everything but a small price to pay i think, if you get ypur money back. It certainly was for me, yes hours spent, printing, researching and finally getting together my files, but i had lots of help and guidance from everyone here on the forum, especially individual people also.
Once you get your date, you will get "instructions" from the judge as to what he/she wants, then take it from there!! you will get so many days/weeks to submit what they want, think i had nearly 3weeks!

When you see people going through what you've been through, you just want to put their minds at rest and remember how it all felt yourself!
Here's the link ... there is loads! The posts which might interest you are the last few ... loads of questions from me about Wasted Costs. The mods. have been really helpful. Hopefully all my questions (and answers) will help others along the way ... that's way I've been trying to get everything absolutely clear for everyone. I'll still be asking away as I try to get it all sorted today no doubt.
