    Hi I would say a 'Paid Item Fee' is something that they have charged you for paying a particular item, for example you write a cheque for £10 but only have £5 in the account, they pay the £10 but then charge you a 'Paid Item Fee'? Maybe give them a ring & ask them to clarify what it is, or just go in the branch & put them on the spot :D as for the other you can add the charges right up until you file it with the courts, if you already have you can amend the figure for a fee of £35 I think but you may ahve to ring to confirm that with them.

    Another thought, it may be worthwhile splitting your £8k down into either 2 or 3 claims to get it under the £5k for the small claims, unless of course your going for the biggy :D

    Hi ljones, I'm at exactly the same place as you, I even have the same court date at the same time and the same place after it was transfered from my local court! I'm going to see my solicitor tomorrow for some advice as even though all the help here is abundant and wonderful I'm just not that confident with getting all my papers in order. I'll come back and let you know what he said, it may be of some help to some but in a brief chat on the phone last week he said that I'd be allowed to make a written representation and not attend because it was transfered from my local court to Cardiff.

    Cheers eyeball. Trying not to get too excited though as, apparently, it's quite common for judges to make another Order, so we'll see .... rolleyes.gif

    Sorry for reposting

    Just wondered if anyone knew the answers to my questions :confused:

    I have rec'd a letter from Wraggle saying :

    We enclose a copy of our client's Defence by way of service upon you.

    Does this mean that they are going to counter claim ?

    Also the letter came from the Northampton Court .. Will this automaticly be changed to my local Court or do I need to request it ?

    Please help :D

  • I received an from A&L today, £83.50! I'm claiming £287 they have said that that the amount offered is the monies over and above the £12 agreed with the oft for credit card defaults. Now where do i go from here is there another letter to write now? Where next please?

    Got in today to find the court has sent me a questionaire to fill out.
    It has to be back by the 23rd July so I'm guessing I'll get a date sometime after that.

    I know the name of the Judge too. Alliance & Leicester have entered a defence, which says things like, their charges aren't penalty's or fines and that they're in accordance with their t's & c's etc etc...all on official solitor type paper etc..etc.

    I'm still hoping they will give it one final push and offer me £1,000 which is what I'd be prepared to accept. So far I have only had two offers and they were very early on in the process, one for £244 and another for £444. Since then nothing.

    They've "threatened" that even if they lose they'll simply remove my £1,400 overdraft to cover the cost. I don't particularly mind that, but wondered if they were actually allowed to do that since, I've operated my overdraft in accordance with their T's and C's etc...

    If the worst should happen and I have to go to court, do I have to appoint a solicitor to represent me or is it something I can do myself ? How much help would an individual get in court ?

    Hi all

    My court case is next wed 11th.

    Wragge & co have not sent anything to me or to the court.

    So fingers crossed.....I will call Wragge on Monday, let you know what happens!!

    Hi all,

    got a questionaire through the post today from the court.
    I'm a bit lost with all of this really. Should I be contacting Wragge / writing to Alliance & Leicester and trying to negotiate or is it up to them to contact me ?

    If I eventually do have to go to court, what do I need to take with me what do I have to do....?

    How do I get access to the fighting fund and so on and so on....

    HELP !

    If it does get to court you can represent yourself if you wish. Either that if you go to

    They have a buddy search system where you can find someone in your local area who will attend on your behalf if you dont feel confident enough to do it yourself.
