    I am upto trying to settle with wragge&co but not getting any replies to my emails. Just got back from holiday so was hoping to have heard something, but not a dickie bird.

    Will get my witness statement sorted (all the court wants) and get that sent. Court date in October - not ideal!

    Sixx - Cheers for remembering, just send them whenever you can, or have i missed a link to a zip file?

    Not at all surprised you've had no reply from Wragge, typicalrolleyes.gif They'll probably leave it for a while, then try to settle as the court date get closer.

    I presume you've found the link to the Witness Statement template on the CAG site? Lucky you just having to submit that.icon7.gif The judges are definitely coming down in favour of the claimant these days, with less and less being asked of them. Have Wragge been asked to submit anything? If they have, they probably won't bother (or won't be able to) and you'll win by default.

    my court date is 18th july, the letter said to send a copy of the court documents to each party before the 4th july, which i have done. Are wragge meant to send me something or does this rule only apply to me? ive not receive anything

    can i apply for a default win? if so, how?

    The judge HAS to put both party's "directions" on the Order out to the Claimant and the bank/solicitor, so you would definitely know if Wragge had been asked to submit anything. Sounds like they haven't, which is sometimes the case.rolleyes.gif

    If this is the case, no, I'm afraid you cannot apply for judgement by default.

  • Hi there, Im new to this site and just wondered if anyone had had any success in reclaiming charges from the A & L. I am about to start court proceedings to claim just short of £500. Any chance they will settle?

    How are you getting on, i havent heard anything from wragge, date in court 19th, not long now, do you suggest i just wait and attend my date or should i maybe try to ring or email wragge to try to settle before 19th,

  • Cre8tor, I'm at exactly the same stage as you, they've just moved my case to cardiff - which is good. But how much longer do we have to wait? It's been nearly 3 weeks since I first put the claim in on MCOL...:A

    Righty - Ho !

    Let me start this post by thanking everyone for their posts on this thread ! All the Q's and A's have been so helpfull so far !

    But I do have a few questions of my own that i couldnt find inn this monster thread ?

    I have gone through the initial stages

    Letter 1 asking for all charges in last 6 years back

    Standard reply Rec'd (in line with T&C's blah blah)

    Letter 2 asking for copy's of charges or statements

    Got these back :T

    Letter 3 detailing all charges and added intrest asking for it all back

    Standard reply Rec'd (in line with T&C's blah blah)

    Started MCOL Served within 5 days

    A&L have acknolwledged (sp) and intend to defend

    I had the 2 letters on the same day trick

    Wraggle & Co - Were going to defend !! Leagal stuff !
    Alliance & Leicester - Were not in the wrong ... but we will give you £120 !!! :rotfl: :rotfl: :rotfl: :rotfl:

    Now I have rec'd a letter from Wraggle saying :

    We enclose a copy of our client's Defence by way of service upon you.

    Does this mean that they are going to counter claim ?

    Also had the letter from the Northampton Court .. Will this automaticly be changed to my local Court or do I need to request it ?

    I will fight this to the bitter end but want to be as prepared as possible !

    Hi Nappy,

    The pattern seems to be that they make contact before the court date, but might be worth emailing them just in case? They may put a few offers in to negotiate before the court date. I'd be inclined to stick it out and go for the full amount, unless they're prepared to offer you this of course.

    Wragge did not submit their court papers in the time specified and Ive applied for judgement by default with local judge last week. Will hopefully hear soon. When I do, I'll report back here.

    let me know when you hear,
    Am not bothered now if i go to court or not, as it sounds like many offers are being made before dates, although i may just email them and see, i have had lots of withheld numbers on my phone of late, maybe just wishfull thinking, could be wragge!!!! my dad gave me a cutting today out of a newspaper that he was reading, stating that a particular court, not sure which one, has asked 2 banks and one of them being, GUESS WHO, A&L and i think, but not sure, Yorkshire Bank, to declare the true costs of their charges, and to state exactly how they amount to their charges!!! so this is a good thing for all claiments,

  • Hi,

    We are currently going through the process of trying to claim back approx £8,000, in charges, on 3 A & L accounts.

    Can anyone please confirm are PAID ITEM CHARGES, the same as Paid Refferal Fee, if not can we still claim them.

    Also Whilst going through the process, we have had additional charges applied, can we increae our claim as we go along, or do we have to start again...!!
