  • Hi,i have now got my court date for 7th august.Whats a court bundle? I have been reading people have had to fill one out.I havent been asked for anything just given my court date.Is this normal,will i recieve anything from the courts.They tell me i have been allocated 10 mins,is this normal.Squeaky bum time!:confused:

    If you haven't been asked for anything by your local judge when you hear about your court date, you don't need a court bundle, so don't worry about it. A court bundle is basically your charges schedule, statements, correspondence, legal back-up papers (i.e. the OFT report), past cases which have been settled, etc., etc. It normally amounts to 200+ pages, so you're luckyrolleyes.gif

    There's no "normal" for court time ... some have 5 minutes, some have one day. It doesn't sound as if you have anything to worry about if you've only been allocated 10 minutes.

  • Ok I have all the statments from A&L am i right in thinking it is the full amount of the charge that is claimed back or did I miss something on the posts

    :A I Am Currently In The Process Of Reclaiming All My Charges Plus Interest And Court Costs Back From Alliance And Leicester To The Tune Of £3461.91 Plus Costs, So Far I Have Had A Defence Put In And Am Awaiting My Allocation Questionaire, I Have Not Had Any Correspondence From A&l Since Putting In My Court Claim Against Them. I Have Compiled A 77 Page Document I Will Be Using In Court When The Day Comes Around And I Am Just Going To Send Their Legal Team ( A Trainee Solicitor ) This Bundle To Keep Them Busy For A Few Days , I Will Let You Know The Outcome Of This If And When It Comes To Court, As Of Yet And I Started This In Febuary 2007 I Have Had No Offers Of Refund Or Anything Else But Am Looking Forward To My Day In Court

    Hi Guys,
    Just to let you know that after a series of offers I have finally agreed to settle for about £40 less than I was claiming. Was due in court on 3rd August but it bacame obvious that they wanted to settle once I had submitted my court bundle. It has taken me since February to get here but at last justice has been done. Hopefully should get money in my account within next 3 days then I will close the account. I did worry that I would not get to this stage as I am sure lots of you are, DON'T they will pay up!!!!

    Charges claimed £454

    Refund agreed £561.12.


    Thanks to everyone on this site especially MIMI not long till you get your sisters money now.

    Don't know if this is good or bad but I'm just out of the court. I was claiming £970 + £200 odd interest. The defence did not turn up, Judge ruled £500 including interest plus the court fee. Reason being "You cant expect free banking":mad:

    Check of the man Grrr. However on Monday the defence made me an offer of £800 so he changed it to £800 + the court fee. Sour !!!!!! he was to.

    I though if the other half didn't turn up it went in your favour!! Infact there was another person there claiming against someone, there defence did not turn up and it went in his favour without any qustioning, I had to go through every charge, baffle on about the OFT stuff and the rest.

    Don't know what to make of it.

    If its a "first offence", pop into your local branch and throw yourself upon their mercy.

    If this doesn't work, read Martin’s article and the Reclaim Bank Charges Help thread and then formally reclaim it.<O:p</O:p

    To every other party" means they must send their documents to you and the court.

    On my directions (which are fairly different), I had so 21 days to submit my papers and then Wragge had a further 21 days to submit theirs (42 days in all ... their time is up this weekrolleyes.gif). Does it say in your directions that if the parties don't comply, the case will be struck out? (i.e. if the solicitors don't submit anything, you win by default). It does say this in mine.

    I'd give the court a ring and ask if you can apply for judgement by default, by sending the judge a letter, as the bank have not complied with the judge's directions.

    Thanks for the advice....I called the court.
    They received my documentation, but had had nothing from Wragge & Co.

    I asked about a default judgement, and the lady there recomended waiting a while as she thought A&L would be settling soon as they'd not submitted any documents.

    The case is about 10 days away.....so fingers crossed!!!!
