I'd say you can charge the statutory 8% interest ... you don't have to try to claim this initially to be entitled to it after you've started MCOL. Certainly try for it.
There's a calculator in Martin's step-by-step instructions (see tab above). Make sure you enter each amount separately into the calculator ... the 8% depends on the date the charge was made.

good luck DJ - this does sound fishy to me, if the cant pay for 10 days they could even provide a confirmation letter on the amount the will settle for, which would obviously help should you run into any probs.

I have today received my history of charges from alliance & leicester, whilst checking for charges I noticed that there were a number of instances where I had gone over my overdraft and not been charged the usual £25 unauthorised overdraft charge. After looking in to it further in these cases my monthly overdraft fee has increased from £5 per month to £25 per month!!! In one instance I cannot see any reason for being charged the higher amount. They have occurred randomly over the last 6 years, reverting back to the £5 charges on all of my other statements.
Are these a sneaky way of charging me the unauthorised fee and can i reclaim them in the same way? I wouldnt have noticed them if I hadnt been looking for O.D charges!
Has anybody had a similar experience with A&L?0 -

the letter states:
upon the courts own motion. The Court has made this order of its own initiative without a hearing. if you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.
IT IS ORDERED THAT
1. Directions will be given in this case by the Designated Civil Judge, His Honor Judge XXXXXXXXXX, on the 14th August 2007 at 10:30am at Cardiff Civil Justice Centre.
2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the Court and the other side at least 7 working days prior to the hearing.
Could someone please help me as i don't really understand what this is saying.
Do i need to submit the court bundles to the court and Wragge & Co?
any help gratefully received.

You need some "expert" help here ... it's vital you get the judge's directions right. I suggest you sign up on the CAG forum (Consumer Action Group). Go to the A&L thread and post under this, stating what the directions are. Hello all.I recently tried to reclaim £75.00 in unfair bank charges from Alliance and Leicester but was turned down via a snotty letter from the manager.I did not go the usual route of requesting statements and sending a cheque etc as I have all my statements due to the account only being two years old.Has anyone else had this problem and did you get your money back in the end and how? Am I the only person in the country to be turned down?0

I also had all statements and went straight to requesting my money back. I think we've all been turned down after the first letter. Lloyds told me to get lost over the weekend so today i sent the next letter threatening court. I suppose you're @ the same stage and need to do this too!shev:cool:0

It sounds like you have agreed to £5 for using your overdraft facility, therefore I would conclude that any addition to this figure is a penalty for exceeding your limit and thus falls into the excessive charge bracket and thus becomes a charge you can reclaim(or at least £20 of it

I have spoken to A&L about this - they were VERY unhelpful! But basically I was told that yes these are in fact charges - a bit sneaky as I didnt check the monthly fees at first but they add up to an extra £100!0
