    I've just done the same and I gave them 21 days to respond before starting the court proceedings.

    Pretty much the day I started I also got an offer back. (I'm claiming £600+ but got an offer of £150).

    I've sent back a letter stating that I won't accept this offer.

    Just follow the process Martin lays out.
    They try to delay and confuse you with their letters. Just keep at it.

    You should start court proceedings after 28 days of first requesting your charges back by letter.icon7.gif

  • I took A & L on beginning of the year and was successful that was for one account and now I am taking them on again but not like the first time they are defending this one. I am at the stage where they have sent me details through the court via solicitors in Birmingham. A & L are saying that I haven't gone about it the right way and not gone to the Ombudsman which I should have done and they are proceeding to take me to court. I am not at all frightened at this news as I have got other things on them, and have it all ready. They are trying to put frightners on by telling me through a Bank Manager that it is going to be costly and things are happening now with the banks/courts that are changing so be ready to go to court. Has anybody else had the frightners put on them? Also has anybody been successful after these sort of threats or have they gone to court?:mad:

    Got a letter today saying that they'd transferred my case to my local court rather than Northampton.... Still waiting with baited breath on that... Claim is for just over £1,200, so far they've offered £244 and £444 not even close to good enough... They've lodged a defence that basically says even if they were to lose the case they'd simply remove my £1,400 overdraft !!! to cover it... I mean..really ...;-))

    As far as I know, they're putting in a defence for every case now ... it used to be a lot easier to claim from them. Totally ignore all the "threats" ... they're just designed to frighten you and are using these tactics on many people. Just follow Martin's step-by-step instructions, keep to the correct time-scales, but do expect it to drag on.

    I started my claim back in January, court case due in August, but they "forgot" to submit their court bundle, so hopefully judgement by default soon.icon12.gif They are also settling in virtually every case before it gets to court and, in the very small handful of people who do have to attend, A&L have NEVER turned up!

    If you haven't already been there, I strongly recommend you join the A&L forum on the CAG site (Consumer Action Group) ... loads of knowledgeable people to give you advice and all very friendly. There are also volunteers there to give you specialist legal advice.

    Not at all surprised you've had no reply from Wragge, typicalrolleyes.gif They'll probably leave it for a while, then try to settle as the court date get closer. They must be inundated.

    I presume you've found the link to the Witness Statement template on the CAG site? Lucky you just having to submit that.icon7.gif The judges are definitely coming down in favour of the claimant these days, with less and less being asked of them. Have Wragge been asked to submit anything? If they have, they probably won't bother (or won't be able to) and you'll win by default.
