I have checked everywhere for an answer to my query but can't find one.

I have a Bank Loan with BOS, I missed a payment in July 2006 by changing my d.d.date details with my bank. I am harrassed at least six times per day
either on my mobile, or business number by BOS. I reached the stage where I
basically looked at the number and refused to speak to them. I have now been issued with a default notice for late payment charges and telephone
call charges. It was only when I actually accepted one call that it was
explained to me why I was receiving these calls for payment for charges. I have been up to date with the monthly payments but not knowing why I was being harrassed it was because of that one missed payment - BOS have to be the most inefficient bank imaginable. I have a complaint with FOS for the
mis-selling of PPI, maybe that's why they are so aggressive towards me.

Anyhow - question - can I reclaim these late paymwent charges on a Bank Loan with the Bank OF Scotland ?

The same principal applies. Additionally, when the OFT gave it's ruling on credit cards charges they said that whilst their ruling only related to cards, they didn't not see any reason why the same principal should not apply to banks and mortgage companies.
  • I have a loan with GE Money at £92pm. Due to a problem with a direct debit mandate one month, GE charged me £22 for the refused debit and £20 for a late payment. A total of £42 extra in one month!

Both these charges are shown in their terms and conditions.

Having read the info on this site, I cannot believe that these charges are proportionate or reflect the true cost of this late payment.

What do you think? Would the same reclaim principals apply to a loan as it does to current account bank charges??

I have managed to claim back my bank charges from Barclays and I am about to start on OH's NatWest Account.

We also had a loan with Black Horse Finance (paid off) and an old mortgage which had charges on them - can I claim these back. Both sets of charges will fall within the 6 year limitation.

    Thanks in advance.

  • Hi.
Forgive me if his has already been asked. Is it possible to claim charges back from a mortgage company that has charged penalty fees and charges for late payment?

    Thanks for reading

  • Yes. I have just successfully claimed from Birmingham Midshires (part of Halifax Group). Received offer today and accepted.

Go ahead you have nothing to lose.

Just tweak the letter for your situation.

  • Hello all this is my first post on here. I have got the ball rolling on reclaiming just over £3500 of bank charges with HSBC and will let you all know how I get on. I am wondering if the same principles work with mortgage lenders. If they charge for late mortgage payments ect. Would I be able to claim back, it's almost the same isn't it?????

    any advice would be welcome

  • Hi to all,

I don't know if this is a silly question or not but every one is talking about bank charges, what about building society and morgages.

A few years ago I was having problems paying my morgage so nearly every month I was getting a letter with £25.00 late payment charges on my account.

Does anybody know whether I could claim those charges back?

    Thanks
