Thanks for your info re Lloyds. I'm at the same stage now with them regarding a partial offer & the same letter saying no further correspondance blah blah blah.
How did your case work out.
Have you gone to court or dropped it?
I'm still not sure whether to keep chasing or accept the £250 out of the £400 owed. It seems like small fry in comparision to other pepole amounts but i just can't close the account & clear the debt otherwise.

    Hi,

I currently have a claim against Lloyds for £410 charges + interest. I got a standard response to letter 1 - charges are all fair, see the T&Cs etc... then letter 2 threatening court was ignored.

So, I raised an on-line claim and their Solicitors have responded saying they will defend it all and will file a defence in 28 days.

Ok, slightly nervous about this but there seems to be different ways in which Lloyds are dealing with people. Some threads show people getting their money back in full after letter 2 and others getting court dates and payment just before the hearing.

    What's your findings ?

I'm just wondering if those who got paid out after letter 2 had waited longer than me and whether that was a better tractic than sticking to the 14 days notice ?

    Any responses appreciated.

    Thanks

    Pete.

    Hi Ottoman

The way that Lloyds treat cases seems to be really random.

Some people claimed a similar amount to me at a similar time and have recieved a refund.

However, they seem hell bent on taking me all the way and I have a court date on 26th March (not a full hearing but a meeting with Lloyds solicitors and the judge to discuss how to progress with the case - hoping that they settle on the morning of this court date).

I can't recall anyone with Lloyds getting a refund before reaching the MCOL stage.

    Good Luck

I am awaiting a reply from my 2nd letter (stating I would undertake court proceedings) but I haven't heard anything. I didn't send it recorded, though.

It is way past the time I set out in my letter.

Should I go ahead with the courts?

Personally I would send the second letter again but by recorded delivery so that I could prove that it had been received.

    Good Luck

    Amount Claiming: £845

I have send off my claim to Lloyds TSB who have just sent a standard 'no' letter back. From reading other posts about Llloyds TSB, it seems you have to go to court with them. Is it too late to do this as a decision is being made in April on the unfair bank charges?

  • No its never too late. Regardless of the OFT ruling you should still shoot for the whole amount. The banks will still settle because otherwise they would have to disclose the true cost of the charges whether OFT rule it should be 12 squid or not and we all know that the banks are unlikely to want to disclose that information!

The OFT would carry weight in a court but it is not gospel and it is most certainly not law.

    Claim on.
