    Just a quick update!!!:rolleyes: :rolleyes:

    I have received my paperwork today from Northampton telling me that my case has now been transferred to my local court.

    Lloyds has filled in their defence telling me that I entered into a commercial agreement when I opened the account, that the charges are fair and reasonable and are not unlawful - YEAH RIGHT!!!!!:mad: :mad: :mad:


    The thing I am worried about first of all is that there is a line in my papers that states: Any party affected by this order may under rule 3.3(5) apply to have it set aside. Can they actually still do this??? What happens if they do?? and for what reason would they do this?? Help:eek: :eek:

    Also if they don't do I just sit and wait for a court date now???

    Got a letter this morning from Lloyds solicitors.

    Basically saying

    We act for Lloyds etc
    We have been passed a copy of the proceedings that you have issued againt our client in Newport County Court. The bank will be defending these proceedings on the following grounds:

    1. The fees that you seek are properly incorporated into your contract with the bank; and

    2. By making payments (whether by cheque, debit card or any other means) from your account where you have insufficient funds to cover them, you are making a request to the bank for an increased overdraft, which the bank may meet or decline. If it meets your request, you must pay the necessary charges. The issue of penalities only arrises as a matter of law, where there has been a breach of contract, and there is no breach of contract here.

    Looking ahead, a situation which gives rise to a dispute is not one the bank wishes to continue. In view of this you are requested, please, to make contact within the next 14 days with your local Lloyds TSB branch manager, on 0845 3 000 000, to review your account. A review may be useful to consider whether your current banking arrangements are the most appropriate for your needs.

    We await confirmation from the bank that this action has been taken.

  • Lloyds defended my MCOL claim today. it now says : you cannot proceed online any further with this claim and will be transferred to the appropriate court' . can anyone tellme what happens next?

    All claims via MCOL are processed thorugh Northampton County Court, as they have now defended, your claims will be passed over to your local County Court and a hearing date will be set. You will receive notification of this transfer through the post from MCOL :D

    so does this mean that at that point you would have to attend court in person -thats what really scares me about all this i wouldnt have a clue!:eek: and how much in court costs are you looking at if you are unsuccessful?

    Yes but few attend a hearing, the bank usually settles beforehand, if not and you attend the hearing the banks never turn up !! Don't worry, all will be well :D

    Hi, i have challenged TSB over some charges, just over £1500 in total, i have received an offer from them of £750, i need to discuss with someone as i am willing to accept a little more, to save any more inconvenience and get it all sorted, they are also planning on paying it into an account i no longer use within 10days.
    I have tried to contact them on all the numbers i hace, 01264 832297/01264 832915 and 01264 725214 all theses numbers are never answered then it says that the holders voice mail box is full.
    Can anybody please help me and pass on a number that i can speak to a human being on please?

    Hi - Im currently dealing with Lloyds TSB and the last number I have is the 01264 725214, I just think they are to busy to answer!!!!
    Im going all the way, and they also offered me £750 and credited my account, as soon as they did I sent them a recorded letter asking them to remove it, they refused and just said it would be deducted from any reward recieved at a later date. Next step is the Lloyds TSB solicitors - sechiari, clark and Mitchell who have now been asked by Lloyds TSB to 'enter into settlement negotiations'
    My local court say that 600 cases a day are currently going through the courts and 99.9% are being settled before the hearing, they are not happy bunnies due to wasted time & paperwork involved.
    Just send letters recorded 1st class post, as they always reply!

    Shelly, write to scam recorded delivery asking them to forward to you this commercial agreement that you are supposed to have entered into, I have had the same wording on mine aswell, my friend (solicitor) is going to ask them for me, if i hear anything from her I will let you know.

    The only cost to you if you lose is your court fee, nothing more...Dont worry about court, they arent in wigs frightening the life out of you, its a basic little office with a suited and booted, chances are, you probably wont even have to speak.
