    Yes Sophiecat. Go backl over the previous few pages and see my posts under ronnie3108. Find them all from about page 175 onwards. We are at the bailiffs stage with Lloyds and as we were not paid by our requested date of 15/06, we had a warrant issued, which ahs gone to our local caourt baillifs for action against our local branch. We spoke with the bailiff yesterday, and Lloyds have 15 days from the date the warrant is issued to either pay up OR have the case set aside (which I've already written to Northampton MCOL court requesting they do not allow LLoyds to do - cos Lloyds have had since my first letter in April and the date of issuing a claim on MCOL on 08/05 to either defend/acknowledge or pay). If they do nothing after 15 days then the bailiff will visit the branch (which is the end of next week) to humilate them in front of their customers. We did call SC&M politely asking whether they were going to pay after judgement by default was entered, and they gave us all sorts of threats about having a warrant set aside. Still going to defend the claim (which in our eyes was too late for them to do by then). We won't recover the cost of the bailiff blah, blah, blah (which I would not be unduly bothered about if they would pay us the £3376 we are due). They are making a load of noise about a case that they have not defended and yet appear to be paying out no problem on the cases whereby they have issued a defence which makes no sense.     I've had 2 of these, the first one after my first letter asking for my charges back and then another after i sent another letter telling them i wished to settle this amicably before i started court action.

    I started Court Action on Tuesday the 19th of June, i then received another letter dated June 22nd that says this.


    "I wrote to you four weeks ago to update you on our investigation of your complaint.
    I am really sorry we are still not in a position to respond fully to your complaint. Because we have not responded fully yet, i want to ensure you understand your rights. So i am enclosing the Financial Ombudsman Services (FOS) explanatory leaflet, which sets out their role and how to make contact.

    You will see from this leaflet that you do have the right to refer your complaint to the Ombudsmanif you are unhappy with the delay. However, i would be grateful if you could please bear with us for a little so that we may try to reach an amicable conclusion.

    I will continue to monitor the progress of your complaint and would like to take this chance to thank you for your continual patience."


    So they send me two standard letters basically telling me to sod off cos their charges are fair and transparent, also telling me how to get my bank statements and how long they have to comply which is a stage that i'd actually gone through weeks ago.

    On the second letter they also get my partners surname wrong...i wish they'd told me we'd got married earlier as we may have attended it lol

    They then tell me after 4 weeks they are still investigating and i should bear with them.

    I won't type what i'm thinking, they now have until July 9th announce they intend to defend the claim.

    My claim was defended on 4th June. I haven't heard anything since. MCOL said it would be passed to local court. I'm a bit worried as I have read on this thread that people have court dates in September. I'm away for 2 weeks of that month. What if I'm away and can't make the court date. Can I re-schedule it?

    i have had that exact same letter this morning and we are just waitng for court date....anyone know what they are playing at?

    Yes you can reschedule it. It will seem like a complete waste of time doing so, because in all honesty your claim will no doubt be settled anyway before the court date - without the necessity of actually going to court. However what I'd do is to advise SC&M of Lloyds of your court date as soon as you get it and give them the opportunity to settle out of court and preferrably immediately. If you are really worried then you will need to phone the court or write to them asking them to reschedule the date because you will be away. they will do it, and with holiday season approaching Me (awaiting a barclays claim court date) & many others are in the same boat.
    As soon as I get my court date I'm going to advise Barclays of it whether I am on holiday or not. If it DOES clash with my holiday then I shall let the court know - but not Barclays at that point in the hope that barclays will settle prior to the date anyaway - without the need for me to re-schedule the date for later in the year - which just buys them more time to hang on to MY money.

    Please help!!

    Sent in my Initial letter to Lloyds TSB, recieved my statemnts wrote back to them asking for Money back, got reply back stating Sorry BLAH BLAH, so I then sent the letter threating to take them to Court, I have not recieved a reply to this, should i now proceed with my Court claim, or write to Lloyds again.

    Stick you your time scale, not theirs! Sometime, as with my IKEA Claim, just entering it into the court system gets the desired response! :)

    Hi all

    Can anyone give me the name of some Banks that i can change to especially for people with poor credit rating.

    I really need to get my account moved as the charges that i am incurring each mont is diabolical. I just cant seem to get myself straight. When i phone they never seem to be able to help. lloydsTSB are an absolute nightmare.

    I am at he stage of sending a letter giving seven days notice and then will proceed to court action. If i dont change banks i will not be able to afford to pay for the court costs.

    Please can any one help!!!

    I found this really useful, I think you have to join the site to read it but it's free to sign up.
    There is a link which lets you print off archive terms and conditions which is a very busy site but persevere, it worked for me and Lloyds paid up last week (funny that never gets boring!)
