  • My claim was defended on 18th June, I haven't heard anything since and I'm not sure what the next step is. Can someone please help....
How long will I expect to wait to hear from a court with a date? Am I also expecting to hear from Lloyds solicitors or does this come later?
I'm moving abroad on 5 August and don't know whether to get a solicitor in case I'm not here to go to court.
Any advice would be greatly appreciated.

You should of received a copy of the defence, from the courts, i'd give the court a ring or MCOL whichever way you filed your claim and ask them the status of the claim and what is happening next :)

    Hi Everyone

Just giving you an update on my claim against Lloyds and seeking some answers to some questions i have.

As expected and as everyone mentioned before Lloyds have filled defence on the last day. I phoned mcol to find find out what the next step and stage would be and been told that it would be directed to my local court (small claims) and that i will recieve a letter from them.

I guess i will have to start preparing my court bundle now lol.

    Here my questions:

    1. Do i have to have a copy of the terms and conditions for my court bundle? If yes i do not have these anymore as we do not bank with lloyds anymore. So if needed where would i obtain these.

    2. Has anyone who hasnt got their account with lloyds anymore won their claim or recieved settlement before court??

    3. Is there anything else i need to do as am getting bit worried now if it does go to court wouldnt know hat to say lol. Also i read that alot of People mentioned to contact scam/scum prioir to court. Should i do so and if yes what do i say?

Also i would like to add a big thank you to everyone posting on this site as it is interesting to see how other people are getting on and progressing and also giving tips to others that still have to go the journey they have already done!!!!!!!!!!!:T

    Hi

I am in exactly the same position as you, but have phoned scam, they weren't interested at all. All they would say that they are waiting for direction from their client. I'm getting really fed up with all of this - it's one battle after another. I have another claim with Lloyds which I haven't been able to afford to put it through the courts and Lloyds are refusing to even look at it untill the other one is settled. I've just complained to the banking ombudsman, copied the complaint to Andover, made a complaint on BBC's watchdog and copied the whole lot to Lloyds PR Dept, lets see if I get a response now?????

    Good luck!

hiya, need a bit of direction plz........... i've had a claim struck out today as lloyds tsb failed to get their allocation questionaire in on time , i phoned the court and they said it's in my hands to recover the money now not them.....so i ring lloyds tsb(scam were closed) spoke to a lady on the phone who said i have to write to their bank charges department and they will write back within 40 days (yes 40 days!!!!!!! ) so i say no thats not good enough i've won the case and i want payment i'm entitled to it immediately and your solicitors will know this.blah blah i end up waiting 10mins for a manager to come on the phone who my husband was initially talking to then the bloke realised that the acount was in my name and REFUSED to speak to my husband (even though i gave permission) so my husband was instructing me on some facts to tell this manager bloke and he pipes up and says ' tell your husband to sit back and be quiet' how rude. i want to close my account but they are saying there are outstanding charges on my Account (£60 overdraft excess fee - and get this i don't even have an overdraft!) yet yesterday my husband was told by lloyds tsb that i could close the account and all charges will be forwarded.

right now my rant is over how do i go about getting the £600 lloyds owe me.any idea's.

I have written to Lloyds TSB using Martin's template stating that I feel the default charges made over the last six years are unfair and I enclosed a schedule of the charges.

I have received a response from Lloyds saying that the charges they have made are not default charges but service charges and are therefore outside The Office of Fair Trading Guidelines. They go on to say that if we cannot come to an agreement then they will provide me with the details of the Financial Ombudsman.

All the templates I can find relate to default charges. Are they trying to pull a fast one and should I continue with my claim using the templates substituting the word 'service' for 'default' charges or should I go to the Financial Ombudsman?

Has anyone received a similar letter?

Those letters from Lloyds are all the same and everyone gets them. They are just trying to distract you. If you don't get any joy from Lloyds after your letters, take the next step and file a court claim.
    Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH

HI GO FOR THE THROAT YOU HAVE WON.... GIVE THEM 14 DAYS TO PAY UP OR START RECOVERY BACK THROUGH THE COURTS WITH THE BAILIFFS IF THEY DON'T PAY UP AFTER 14 DAYS THEN THEY WILL HAVE TO PAY THE EXTRA COSTS OF THE BAILIFFS AS WELL.. BUT DON'T FORGET TO FIND OUT HOW MUCH THE BAILIFF WILL COST AND MAKE THEM AWARE OF THE FURTHER COSTS THEY WILL INCURE.... ( ALSO MENTION COMPENSATION FOR UNDUE STRESS THEY ARE PUTTING YOU UNDER)
