    This moring i've received notification of the court striking out the defence on my 2 claims as an abuse of process. It reads;

    The basis for this is the fact that the defendant is settling all claims of this nature where the claimants are seeking the reimbursement of bank charges, with no claims proceeding to a contested hearing.

    The court considers the authority of Mullen-v-Hackney London Borough Council.

    If the defendant objects to the strike out it is ordered to file within 14 days of the date of service of this letter (19th June) a scedule setting out all claims of this type in England and Wales which have proceeded to a final contested hearing and the outcome of such hearings, together with a scedule of all such claims which it has compromised before a final hearing and proceedings have been issued.

    Upon receipt the court will consider listing the claim for an on notice hearing of the striking out issue.

    In the absence of any such objections being filed in time, the defence herein will be struck out and judgement entered for the amount claimed by the claimant together with the appropriate costs claimable on the small claims track.



    Does this sound good for me ? Has anyone else had this ? :D

    I had pretty much the same letter from my local court last week - 2 days ago Lloyds put the money into my account.
    Good luck, hopefully they'll settle now!

    Mine was lincoln, so fairly close by. looks like the courts are starting to get fed up with the banks abusing the system. hope you get your money soon.

  • I have had a claim ongoing with lloyds tsb since january. I've been following these threads closely since then getting more and more stressed about the whole process in particular the prospect of going to court. And even more concerned since the "Hull Situation" developed. Last week I recieved my court allocation questionaire which I was just getting around to completing when I received a letter from the bank's solicitors yesterday offering full settlement!!!! I know it's not over until the money is in my account but looks like someone turned on the light at the end of the tunnel. Hope you are all as fortunate with your claims as I appear to have been.

    Hi all,

    I have a court hearing in August. Would it be a good idea to give SCAM/SCUM (or whatever other acronym they may be called by) a call, to remind them of the hearing and to ask if they would like to settle out of court?

    Amount Claimed - £1738.74 (£1518.74 Charges + interest; £120 Court Fee; £100 Allocation Questionnaire)

    Amount Offered - £1752.39 (The above + interest accrued on charges since the beginning of the journey)

    I have followed the advice of MSE to the letter, and went as far as posting the Allocation Questionnaire - about 9.15 this morning. At 10am, two letters from Sechiari Clark and Mitchell - the first I opened said that they were to defend the case. The second one, without prejudice, basically set out how they felt that their charging was legal, and that my claim for repayment was misconceived. I turned to the next page, and it said that they are willing to settle in full, including an extra £13.65!!!!

    Result, and for any one else on the journey, hang on in there!

    What do I do from here please. I've sent SCAM information that they requested about the claim 3 weeks ago as they saying they want o sort out a settlement. But have heard nothing since.. what stuff do I need for court please.

    I'm also thinking of giving SCAM a ring. If I do, what would be advisable to say/request? --- I really don't want to regret it later. I'm getting very worried, will somebody please please please help.
