  • Its very rarely that you have to go to court. These cases if less than 5k are settled in a small claims court where the Judge looks at the case & decides. If you lost you would only lose the £50 you paid to take it to court. So far no one has lost against a bank. Just hope you have better luck getting your money back without having to send bailiffs in.

    It is true that the bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc.

    However, this doesn’t mean that you “win” automatically. You still have to prove to the judge that you are due your charges back.

    In the small claims courts, if the claimant “loses” they do not have to pay the defendant’s costs.

    There have been a few claims where the claimant did "lose". The last two were down to poor preparation. One did have more than his fair share of bad luck on the day, the other one just made a complete "pigs ear" of things.
    The acquisition of wealth is no longer the driving force in my life. :)
  • I thought I was going to have to take lloyds to court re current account and credit card charges but they but suddenly credited me for current account on Friday (not in full so I am going to call them) and I am yet to hear re credit card... Hang in there! And thanks moneysaving expert, so far I am £750 less indebted (if they pay the card I will be almost out of debt, except for the mortgage).
  • hi everyone!well my second letter has gone of to lloyds/tsb but i guess is still have a long wait to go :mad: but can they refuse you your money for having a !!!! account or not having the money in when the direct debits came out?they are a s**t bank they really are i have been waiting 5 months now how long will it take from this point :confused:

    no acknowledgement or defence to claim which was issued on MCOL on 08/05/07.
    Entered Judgement by default and lloyds have still not paid despite requesting money by 15/06/07 and politely asking & SC&M and Andover recovery to settle. So yesterday we requested a warrant to enforce payment on MCOL to be served to our local branch. Waiting to see what happens

    I've claimed online with mcol and am at the aknowledged stage...

    TSB were deemed to be served the claim on 9 june and aknowledged on 13 june.

    I'm presuming I just sit tight now untill around 9 july?

    :mad: I have got the bank statements, worked it out to be over £4500 lloyds bank owe my mum.Twice i have give them 2 wks to cough up or we will take them to court.Last week my parents had a nice long letter.The 2rd page just says if i wish to pay £10 to get the bank statements sent to me which i already have. the 1st page says the following:
    thank you for getting in touch with us.I am sorry you are unhappy about your account charges.Like any business we do make a charge for some of our extra services.when customers dont have enough in their accounts to cover a payment, this always means extra work and it has to happen very quickly. we have to agree to make the payment by setting up or increasing an overdraft or tell customers we cant agree. we feel fair to charge for this service.of course it only fair too, that we're completely open about any charged for services before you might need them,thats why we take care to give every new customer the latest guide to our charges.you can also get up to date details about fees adn borrowing rates at all our branches thorough our helpline and on our website.just as importantly we do everything we can to help our customers avoid these charges.you can get a upto date balance at any of our cash machines over the phone, on line and by weekly text to your mobile.
    This goes on for another half a page.

    So do i go ahead and take lloyds bank to the small claims court?
    as the 14 days is now up
    any one help?
