    After taking AQ to court Monday morning,and sending copies to Lloyds,received settlement letter this morning!!! For the full amount...

    Hi

    Ihave been on the case now with Lloyds since November, and now have a court case for 3/8/07, I have received a letter from my local court, Bournemouth, that it is ordered that.

    1. The case be allocated to the small claims track(hearing)

    2. The parties simultaneously do file at court ans serve on the other party their own statements, ant witness statements, and a copy of any documents they wish to rely on by 4pm 18/6/07.

    3. The original documents be brought to the hearing

    4. Each party to file at court and serve at least 5 days prior their skeleton
    argument.

    5. the hearing is for 1hour 30mins.


    etc etc.

    Is this standard, which one is classed as the court bundle, and if Lloyds do not submit their statements by the 18/6 which i have done, where do we stand legally? Has anyone else got this point and they make an offer?

    Hoping someone can help

    hiya, I have gone through the whole process of claiming charges, I got up to the court stage (they sent me a letter saying they didn't have an outcome for me yet and could I be patient and wait another 40 days!:mad: :rolleyes: )
    so as I couldn't afford the court fee I stuck it out, I received a letter on the 19th of june with all the fobbing off, e.g. "you are warned about our charges, there are lots of ways of checking you bank e.tc, however on this occasion we are prepared to offer you £750 in full and final settlement of this case, within the next 10 days" (I am claiming 1500 (with interest)
    I then checked my bank on the 20th and they had paid it in.
    I do not know what to do as I still can't afford the court fee-especially not if lloyds tsb win then I have to pay the £750 back too! (I haven't touched this money!)
    Any ideas on what to do?

    I think I would write back accepting the payment as 'partial payment' only! and say that I would intend to recover the remainder via the court process. I would then pay the court fee from the £750, but not touch a penny more. I would feel confident that the bank would lose!!!!!

    Hi all
    Well I have finally found out why I haven't had any sort of reply to my claim since I made it 9 weeks ago.
    I finally got through to a lovely lady at Andover who informed me that my claim wasn't on the system and that I would have to start the process from now.
    I rang the Finacial Ombudsman service dept and spoke to a guy who said unless i can prove Lloyds had received my letter in the first place I would have to start again. I asked if a letter from my local branch manager informing me they had sent my first letter on would do.
    It appears it will do nicely and as the bank have breached the FOS rights of my case he's sending me a form to fill in.
    hopefully I'll be getting something soon.
    Don't give up out there and as a special note to the bank's powers that be that monitor these type of discussion boards "get a grip and give us our money back pronto. Please"
