    Hi

Ihave been on the case now with Lloyds since November, and now have a court case for 3/8/07, I have received a letter from my local court, Bournemouth, that it is ordered that.

    1. The case be allocated to the small claims track(hearing)

    2. The parties simultaneously do file at court ans serve on the other party their own statements, ant witness statements, and a copy of any documents they wish to rely on by 4pm 18/6/07.

    3. The original documents be brought to the hearing

    4. Each party to file at court and serve at least 5 days prior their skeleton
    argument.

    5. the hearing is for 1hour 30mins.

    etc etc.

Is this standard, which one is classed as the court bundle, and if Lloyds do not submit their statements by the 18/6 which i have done, where do we stand legally? Has anyone else got this point and they make an offer?

    Hoping someone can help

    Cheers.

I did reply to this earlier but haven't a clue where my reply has vanished to!
I had a letter similar to this except both parties had to send all documentation i.e. Court Bundle to each other 14 days before Court date.
If you log onto www.consumeractiongroup.co.uk you will see the next step if the SC&M haven't sent anything to you is to send a non-compliance letter. The template for this is on the CAG site. You also fax the letter first, send it recorded and send a copy to the Court with a covering letter. SC&M settled in full two days later with us. Hopefully you won't have to go to court and will be as lucky as we were. Good Luck ;) .

what i would like help with is it states on the notice of transfer that it is ordered that:- the filing of an allocation questionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise.Has anyone else had the same thing.

    Yes its pretty standard Lloyds.
Now just sit tight and wait for your court date, start getting your court bundle ready and then wait for them to pay up just before... good luck

    MORNING ALL:D

Recieved my first response from Lloyds this morning basically telling me to p**s off.
But there's a bit at the bottom i dont understand!
**It says you might be interested to know that the OFT published new guidelines on credit card charges in Apr 2006. We along with other banks have been talking through those guidelines with the OFT since then, as they are about "default" charges that people pay when they break an agreement with us.
Those guidelines do not apply to your service charges- they are not default charges as you haven't broken your agreement with us. If i haven't broken my agreement with them why did they take my money. Am i stupid, i just dont understand!**
Could someone please shed some light?:confused:
My claim is for the period of 2002-2005.

    Hi,
I did the same as Lara, my court date is for 29th June I sent huge bundles (including terms & conditions) to the Court and to Scam by the date the judge asked for, received nothing from SCAM. I had printed my non compliance letter and was just about to post when I checked my account as B$%@** me if it was not all sitting in my account looking dead gorgeous!.
    Good luck
  • When they pay you is it an instant credit on the account or do they send a bacs payment so takes a few days to get to the account ....? I know random question :rotfl:

    Kez,
I never had any pre warning the money was just there! Just credited to my account saying BC REFUND and quoting my claim number.
I was refunded the amount plus interest plus court fees.
However one thing I have learnt is that no two cases are the same, Lloyds are incredibly inconsistant:rolleyes:
