As Martin has said in his article - whatever the banks say and do, it is just another step in the dance. They will try and confuse and play for time, but if we are prepared to play the long game when necessary,i t will produce results.
I know the waiting and reponding to their nonsense is a pain, but you will get there. There is plenty of help on this forum and the site. Do use it, that is what it is there for. Don't give up. When Lloyds defended our claim at the last minute I was angry too. But the very next day they sent a letter offering the full amount. I know that won't necessarily happen to everyone, all I am saying is you don't know what's round the corner, so don't let them beat you, you have come so far!Reclaimed thanks to this site:

What about the interest ?Will the interest remain the same ? I've already done the spread sheet to work with the 8%.
Now that Lloyds have had a second win, and in each of their wins, the sticking point has been paperwork, would you advise filing an N1 based on the adice that it constitutes a more substantial claim ?

You don't send the court papers to anyone at the moment, if you file on MCOL the will transfer your case to whichever court is nearest to the address you give.
You'll find links to the courts webpages in the Reclaim Help Thread along with the bank address that you need to use. You can download the N1 form from the court webpages or you get them at your local court.
As you are accepting the £750 before you fill in MCOL you must deduct this from your total claim.0 -

Same has happened with me. They entered a defence yesterday. It's funny that when I was trying to call them on their Recovery Centre number they seemed to be constantly engaged for about 6 weeks. Once the court gets involved they noe find they do have time to acknowledge me.
Anyway, gonna press on with it. I was hoping it wouldn't get this far as I'm not sure how to represent myself in court - hoping for an offer before then but we'll see.

i have got up this morning ready for a fight wiv ltsb. been working this morning on everything, gathering all my letters etc tht i have been sent. i want to be all prepared now so i dont panic when the date is set and solicitors letters start coming in. :T
just need to know a couple of things now if you can be very kind ( as u all are ) what sort of stuff do i need for the bundle and solicitors
can anyone please let me know.

i have recently recieved letter form lloyds with response to my first letter request of charges,had sent off tamplate letter from Martin's posts.
i am claiming for £165 in charges.
The letter received basically says;
Thank you for getting in touch with us.i am sorry you are unhappy about your account.
Like any business,we do make a charge for some of our extra services.When customers don't have enough in their accounts to cover a payment,this always means extra work-and has to happen very quickly.We have to agree to make the payment by setting up or increasing an overdraft,or tell customers we can't agree it.We feel it's fair to charge for the service.
Of course it's only fair too,that we're completely open about any charged-for services before you might need them.That's why we take care to give every new customers the latest guide to our charges.You can also get up to date details about fees and borrowing rates at all our branches,though our helpline and on our wesite.
Just as importantly,we do everything we can to help our customers avoid these charges.Youcan get an up to date balance at any of our cash machines,over the phone,on line and by weekly text to your mobil.
If you know a payment is going to take you over your agreed limit,you're welcome to see if there's anything we can do.
The Office of Fair Trading has published new guidelines on credit card default charges.We're still talking it through with them,but the important point is the guidelines are about 'default'charges that people pay when they break an agreement with us.This does't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit.They are not default charges because you have'nt broken your agreement.They are our prices for the service we provide in these situations.
I do hope you can see that we make our charging system as fair as possible and why i can't agree to cancel your charges.
I hope this answers the point you raised with us.Please let me know if there is anything else i can do to help.If we cannot come to an agreement ,i will provide you with details of the Financial Ombuudsman Services so they can consider your compliant independently.

Hi, this is just one of their standard bog off letter saying they think their charges are fair etc, many of us on here have them, continue on sending the template letters and threatening court, stick to your timescales, and if you have no joy file at court to get your money back,
