    Lloyds have not yet acknowledged my court claim, is it possible that if they don't hear from me following the goodwill payment, they will consider the case closed and not bother acknowledging the claim, thus letting me win by default?

    I am considering leaving the claim open, ignoring the goodwill payment completely and just hoping Lloyds don't respond to the claim, thus meaning they will be forced to repay the remainder of the charges after the 14 days are up. Do you think this is a wise course of action or should I definitely contact them whatever I decide to do?

    Although I'm just a newbie, my personal opinion would be to write back to Lloyds and say that the goodwill payment will be accepted only as a part payment - without prejudice - but that you are still going to fight for the rest.
    My worry would be legally that the letter which accompanies the goodwill offer usually states that it is their "full and final settlement" therefore if you just ignore it, legally they could turn around and say that they'd assumed you were happy.

    As I say, I'm still new to all this myself, but when I got that letter from Lloyds offering me the £750, I replied to them within a few days (once the money was in my account). I'm sure others will advise differently if I'm wrong!!

    I received a letter from Lloyds' solicitors agreeing to pay the full amount, which I will obviously be accepting.

    However, phoned them today and they said it is likely to take 3 - 4 weeks to receive the funds.

    Has anyone been in this situation? If so, is there any way to speed things along, i.e. taking the letter into my local branch!!??

    hi, can anybody help please? We have just received a court date of 16th august, today and are wondering whether we should contact the Solicitors for LLoyds TSB and ask if they are willing to settle out of court.

    not quite sure how to word this though, does anybody have any tips for doing this please?

    My MIL rung me up to say she's recieved a letter from the court back to say that the case has been sent over to Lloyds now and they have up untill June 22nd to acknowledge. Fingers crossed they don't acknowledge it,hoping thay miss it,or forget. Not likely I know but we live in hope. I go on holiday on the 25th so if they acknowledge im gonna be spending the whole of my holiday worrying about if they gonna defend! :rolleyes:

    Strange. They sent us a letter after accpting their full settlement saying it could take up to 7 working days. It took less than that. Don't cancel your claim until you have the money!

    There's no danger of me doing that!

    Did you also get a letter saying to contact your bank manager on some vague 0845 number to discuss the running of your account? I intend to ignore this as well until they pay up.

    just checked MCOL, ltsb have filed defence.

    feel like crying. i want to give up now. dont know if i can go thru anymore an face the fact i may need to go to court.

    ive also had a knock back of my credit cards. they say cus i signed for the account i agreed to the charges, my next step is to file court, but i feel so blerrrrrrrrrrrrrrr i cant be bothered lol.

    The Court will tell you within the next week or two where the case has been refered to. It will be your local County Court

    It is standard procedure - nothing to worry about. The advantage of this is that I went down to my local court and chatted to the admin staff, who put me at ease and answered questions.
