Hi they now have 28 days from the date of service of the claim to submit a defense against you. If no defense is submitted then you can claim judgement by default, if a defense is submitted then the case will be transferred to your local court for a hearing date to be set,

Just want to get a response from anybody who has sent the baliffs into there bank.
Claim is for £10,650.00 on my business account, they acknowledged back at the start of may but never entered a defence, so took automatic judgement 2 weeks ago, still no money so entered a warrent of execution and recived a letter today so say it was issued on the 4/6/07.
Does the baliffs let you know when they are going as i want to let the local media know about it.
Please read my lengthy story of warrant of execution in April no money yet. Barclays have informed MCOL they paid in April, but I understand from the
Court the Bailiff didn't deliver his letter to the branch until middle May.
The message that they paid in April only came up on the MCOL site yesterday.

You need to wait to hear either from the court and/or the banks solicitor who will ask for further information. The court may send an Allocation Questionnaire but they are dispensing with this at the moment to speed up the process, if you have further court costs to pay they will ask for it at this stage.

I spoke to the court today to see if my judgment has been issued yet, ( requested on 9th May, returned to me for amendment on 16th May, returned back to court on 21st May)
And it has!!!! Judgment issued on 6th June!!!
Although i do not have it in my hand yet, how long do lloyds usually take to repay the money?
Any help or comments would be appreciated. THANKS:beer:0 -

They filed a defence with my claim last week and I'm now waiting for a court date. I'm also worried however they owe me the money and I'm going to get it..

LTSB just filed a defence on my case as well... I am kinda nervous but will keep fighting, whats the worse that can happen!!

I got Judgement on the 18th May and the money was paid into my account 1st June. I wanted them to then close the account but they havn't so I'm now trying to close it myself but they are none to helpful.0 -
The bank as put money into my account, I have had no reply to any of my letters regarding charges,can I still take to court and if so do I subtract the amount from my claim?0

Yes and yes. Write a letter to the bank that you are accepting the money without prejudice and as part payment only and that you will be pursuing the rest through the court.Reclaimed thanks to this site:
